Recreational spearfishing (pesca con arpon en apnea) is legal in Puerto Rico but tightly regulated. In Puerto Rico jurisdictional (territorial) waters it is governed by the DRNA Reglamento de Pesca de Puerto Rico. Spearfishing is allowed only while freediving/breath-hold (en apnea): it is illegal to use a speargun and a diving tank (SCUBA) at the same time. Spear-fishing is prohibited at docks, designated bathing areas, marine reserves and artificial reefs, prohibited at night (sunset to sunrise), and prohibited within 100 feet (30.48 m) of the coast where the spear must be kept unloaded. A recreational saltwater fishing license from DRNA is required for anyone 13 or older. In adjacent federal waters (the EEZ around Puerto Rico, generally beyond 9 nm) NOAA / 50 CFR 622 applies: powerheads may not be used to take reef fish, Nassau and goliath grouper, three parrotfish species, queen conch and certain rays are fully protected, and several spawning-area and species seasonal closures apply.

Federal prohibited gear and methods in the EEZ around Puerto Rico (powerheads, poisons, gillnets, spears for lobster)

Trawl, trammel net, and purse seine gear are prohibited for use to fish in the EEZ around Puerto Rico. [...] (a) Reef fish [...] (1) Poisons. A poison, drug, or other chemical may not be used to fish for reef fish in the EEZ around Puerto Rico. (2) Powerheads. A powerhead may not be used in the EEZ around Puerto Rico to fish for reef fish. (3) Gillnets. A gillnet may not be used in the EEZ around Puerto Rico to fish for reef fish. [...] (c) Spiny lobster (1) Spears and hooks. A spear, hook, or similar device may not be used in the EEZ around Puerto Rico to harvest a spiny lobster. The possession of a speared, pierced, or punctured spiny lobster in or from the EEZ around Puerto Rico constitutes a rebuttable presumption of a violation of this paragraph (c)(1).
Federal prohibited species in the EEZ around Puerto Rico (Nassau/goliath grouper, parrotfish, queen conch, rays, corals)

Any of the following species caught in the EEZ around Puerto Rico must be released immediately with a minimum of harm. (a) Reef fish. No person may fish for or possess the following reef fish species in or from the EEZ around Puerto Rico. (1) Goliath grouper or Nassau grouper. - HOOKAH (surface-supplied air compressors) prohibited for fishing (DRNA Art. 13 inciso i).
Recreational spearfishing in Puerto Rico is essentially a freediving activity. Spearfishing on SCUBA is not permitted. Equipment commonly used: speargun (arpon/fusil), mask, snorkel, fins, weight belt, dive knife.

Reef fish below the legal sizes in the regulation's size appendix must be released. Territorial minimum sizes above (yellowtail snapper 10.5 in, snook 22 in, queen conch 9 in shell, spiny lobster 3.5 in carapace) are confirmed against current DRNA / Sea Grant PR guidance and converted to cm. Federal minimum sizes (dolphinfish 24 in, wahoo 32 in fork length) are from NOAA Amendment 3. Earlier unverified figures (a silk-snapper minimum and a snook upper slot limit) were removed pending a primary-source citation. Verify exact current figures against the DRNA Reglamento Num. 7949 size appendix and current 50 CFR 622 rules before fishing.

Puerto Rico is an unincorporated U.S. territory; spearfishing is governed by two layers. (1) Territorial/jurisdictional waters (out to ~9 nm): DRNA Reglamento de Pesca de Puerto Rico. The verbatim Spanish provisions captured here (spearfishing gear/area/night rules, license fee table, mero cabrilla veda, grouper protections, powerhead ban) are from the official Reglamento Num. 6768 (2004) PDF on drna.pr.gov. This regulation was superseded in 2010 by Reglamento Num. 7949, which is the CURRENT in-force local fishing regulation and retains the same core spearfishing rules (apnea-only spearfishing, no speargun+SCUBA tank, 100 ft unloaded-spear rule, marine-reserve and night prohibitions). The 7949 PDF could not be machine-extracted at access time (large PDF / repeated fetch timeouts), so its exact verbatim wording and inciso numbering are not quoted here; where the 2004 numbering is cited it may differ from 7949. IMPORTANT CORRECTION: the queen conch (carrucho) closed season was corrected from 1 Jul-30 Sep to 1 Aug-31 Oct, which is the period set by the in-force Reglamento Num. 7949 (Art. 8) and reaffirmed in DRNA veda announcements; the older July-September window did not match the current regulation. Sama (mutton snapper, 1 Apr-31 May) and land-crab (15 Jul-15 Oct) closures are confirmed via official DRNA notices and the DRNA/Sea Grant PR veda table but their exact verbatim text was not retrievable, so no verbatim law_text is asserted for them.
