Recreational spearfishing (pesca submarina / caca submarina) is legal in mainland Portugal and is one of the four recognised modalities of recreational sea fishing (pesca ludica). It requires a specific recreational fishing licence issued by the DGRM (or the 'all modalities' licence). It may only be practised in apnea (breath-hold); the use of any artificial breathing apparatus (scuba / compressed gas) while spearfishing is prohibited, and a speargun may not be carried on board a vessel together with breathing apparatus. The spearfisher must be marked at the surface by a signalling buoy/board flying the international Alfa flag, which must stay within 30 m. Night spearfishing (between sunset and sunrise) is banned, as is the use of speargun propulsion based on chemical detonation or compressed gas. A daily catch limit of 15 kg applies to spearfishing (largest specimen excluded). Selling any recreational catch is forbidden. Spearfishing is prohibited or heavily restricted inside several marine protected areas (Berlengas, Arrabida/Luiz Saldanha, SW Alentejo & Costa Vicentina, Litoral Norte). Capture of the dusky grouper (mero, Epinephelus marginatus) is prohibited. The autonomous regions of Azores and Madeira have their own separate regimes.

Rajoitukset

  • Spearfishing may only be practised in apnea (breath-hold); use of artificial breathing apparatus (scuba / compressed gas) while spearfishing is prohibited (Decreto-Lei 246/2000, Art. 9.o(3) and Art. 14.o(1)(o)).
  • Speargun propulsion may not derive from chemical detonation or artificially compressed gas (i.e. powder/pneumatic-explosive guns banned); hand or throwing capture tools allowed.
  • Carrying or keeping a speargun and artificial breathing apparatus simultaneously on board a vessel is prohibited.
  • Mandatory surface signalling: a clearly visible buoy or board flying the international code Alfa flag, kept within 30 m of the spearfisher; vessels must keep a 50 m safety distance from Alfa-flagged signalling equipment/vessels.
  • Use of artificial light sources as a lure/attractant underwater is prohibited (except permitted use of toneira for cephalopods).

Spearfishing must not be practised within the legally established distance of concessioned (lifeguarded) bathing beaches. Minimum age and licence eligibility: minors under 16 are exempt from licensing only when accompanied by a licence holder; licence applications for minors require parental/guardian authorisation.

  • Allow advance processing time (about 5 working days for regular, 3 for urgent requests).

Rajoitukset

  • Mainland licence does not cover the Azores or Madeira, which require their own regional licences.

  • Partial Nature Reserve of Garajau on the south coast of Madeira, east of Funchal — the first exclusively marine protected area in Portugal (Decreto Legislativo Regional 23/86/M, 4 Oct 1986). All fishing activities, commercial or sport, and spearfishing are prohibited throughout the reserve; only amateur diving and non-motorised nautical activities are allowed. Patrolled by the coast guard.

  • Marine nature reserve on the north coast of Madeira (Santana municipality), delimited between Ponta de São Jorge and Ponta do Clérigo, covering ~1710 ha of seabed up to 100 m deep plus the Rocha das Vinhas and Viúva islets. Underwater sea hunting (spearfishing) and net fishing are strictly prohibited.

  • Nature reserve comprising the Desertas Islands (Ilhéu do Chão, Deserta Grande, Bugio) and their marine area, ~22 nautical miles southeast of Funchal. Underwater fishing is strictly prohibited and navigation south of the protected area is restricted.

  • Selvagens (Savage) Islands Nature Reserve, ~250 km south of Madeira (Selvagem Grande, Selvagem Pequena, Ilhéu de Fora) — one of the first nature reserves in Portugal (1971) and the largest fully-protected MPA of the North Atlantic, a strict no-take protection area where all extractive activities including fishing are prohibited. (Note: recent regional debate about opening to commercial tuna fishing; spearfishing remains barred.)

  • Marine nature reserve / OSPAR MPA on the Formigas bank and Dollabarat Reef, between São Miguel (~33 nm) and Santa Maria (~20 nm); part of the Natura 2000 Special Conservation Area and a Ramsar wetland, where any fishing activities including recreational/sport/spearfishing are prohibited.

  • Vila Franca do Campo Islet Nature Reserve off the south coast of São Miguel; the islet and surrounding waters were decreed a nature reserve in 1983, with protected waters extended to 350 m around the islet in 2004 and fishing restricted/prohibited within the protected zone.

  • Marine nature reserve on the Banco D. João de Castro submarine volcano, located between the islands of Terceira and São Miguel. Classified as a Natura 2000 site (PTMIG0021) and OSPAR protected area — the only volcanic seamount in the world with both designations. All fishing activities, including commercial, recreational, and underwater (spearfishing), are prohibited; enforcement has led to vessel seizures and fines of up to €37,500.

  • Marine nature reserve on the Condor seamount, located approximately 17 km west-southwest of Faial Island. Demersal fishing has been prohibited since June 2010 and the area is designated as a total-protection no-take zone under the RAMPA (Decreto Legislativo Regional 14/2024/A); all extractive activities including spearfishing are banned.

  • Marine nature reserve on the Princess Alice Bank seamount, located approximately 50 nautical miles southwest of Pico and Faial islands. Designated under the Azores Marine Park (RAMPA, Decreto Legislativo Regional 14/2024/A) as a total-protection zone where all extractive activities, including spearfishing, are prohibited; designated IUCN category IV. WDPA 555514088.

  • The only voluntary marine reserve in the Azores, located approximately 150 m off the coast of Corvo island in front of the port of Vila do Corvo. Established through an agreement between local fishermen, divers, and the University of the Azores to protect the exceptional dusky grouper population; all fishing is forbidden. Subsequently incorporated into the Corvo Nature Park and recognised under the National Maritime Spatial Planning Plan (PSOEM-Açores, Resolução 136/2024).

  • Ilhéu de Cima (Rede de Áreas Marinhas Protegidas do Porto Santo)marine protected area (total protection zone)

    Ilhéu de Cima is the most strictly protected zone within the Porto Santo Marine Protected Areas Network (RAMPPS), established by Decreto Legislativo Regional n.º 32/2008/M. Within the marine area surrounding this islet all fishing activities are prohibited — including recreational fishing and underwater hunting (spearfishing) — making it the only total no-take zone in the network. Across the rest of the network spearfishing is permitted only with authorization/licence.
