Recreational/amateur fishing (pesca amadora) is a category of fishing expressly recognised in Sao Tome and Principe's national fisheries law (Lei n.º 9/2022, Lei das Pescas e da Aquacultura, as amended by Lei n.º 07/2025). No statute specifically names or prohibits spearfishing or underwater fishing (pesca submarina), so it is treated under the general amateur-fishing regime. Amateur fishing is exempt from the commercial fishing licence (Art. 30) but is subject to a mandatory authorisation and registration (Art. 40-41); fishing without the required registration is a minor infraction (Art. 140). Detailed operational rules for amateur fishing (gear, methods such as spearguns, areas, catch limits) are to be set by a Regulamento da Pesca Amadora foreseen in Art. 13(2)(f), which had not yet been published as of the latest source. Fishing is forbidden inside marine protected areas / reserved maritime areas (Art. 137); a network of eight such areas was announced in 2025 but the establishing Decreto-Lei was still awaiting presidential signature and publication as of the latest source, so its zone boundaries are not yet legally in force. Capture of corals, ornamental aquatic species, sea cucumbers and seahorses is prohibited nationwide, and lobster capture is suspended (Decreto n.º 19/2020). Because the implementing amateur-fishing regulation is still pending, the practical legality of spearfishing for an individual diver is best described as restricted/uncertain.

Artigo 3.º – Da proibição. 1. Decreto n.º 19/2020 prohibits capture/trade of corals, ornamental aquatic species, sea cucumbers and seahorses (Art. 3(1)), and suspends capture and trade of lobster of any species (Art. 4(2)); it also suspends shark-fin export/re-export/import (Art. 4(1)). On quantities: these are EXPORT-permission thresholds, not catch (capture) limits — Art. 3(2) prohibits exporting octopus (polvo) above 10 kg per person, while Art. 5 permits export of up to 10 kg of octopus and up to 1 kg of crab (caranguejo/santola) per natural or legal person. They restrict commercial export, not the amount a spearfisher may land. No species-specific minimum landing sizes or daily bag limits specific to amateur/spear fishing were found in the consulted legal texts; these are expected in the pending amateur-fishing regulation.

Lei n.º 9/2022 applies to fishing activities by natural or legal persons, national or foreign, in national maritime waters (Art. 2(2)(a)), and the protected-species decree applies to nationals and foreigners alike (Decreto n.º 19/2020, Art. 2). No specific rule was found that singles out foreign recreational/amateur spearfishers or imposes a distinct foreigner licence; such conditions would fall under the pending amateur-fishing regulation. Practical access for tourists also depends on dive-operator and resort rules and on MPA boundaries. Marked unknown where the law is silent.

  • Under Lei n.º 9/2022 (Arts. 15-17, 137) fishing and other prohibited activities are forbidden inside marine protected areas (fisheries-protection areas: fishing reserves, marine-conditioning areas, restocking areas; and environmental-protection areas: marine reserves, marine national parks, marine natural monuments, voluntary community-protection areas). Fishing in reserved maritime areas / protected areas is a very serious infraction. Each MPA is created and bounded by its own Decreto-Lei.

  • In June 2025 (announced during the UN Ocean Conference in Nice) the Government announced the creation of the country's first formal network of eight marine protected areas (six around Principe, two around Sao Tome), totalling approximately 93 km2 of marine habitat, managed under the guidance of the Fisheries and Aquaculture Directorate (DPA) with partners (Fauna & Flora, Oikos, Fundação Príncipe, MARAPA). The establishing Decreto-Lei was approved by the Council of Ministers but, as of the latest reachable source (rede-ampstp.com, early 2026), still awaited the President's signature and publication in the Diário da República to come into force; the individual MPA names, boundaries and exact fishing rules were not yet officially published, so they are not enumerated here. As of June 2026 no confirmation of publication was found.

  • Tinhosas Islands (Tinhosa Grande and Tinhosa Pequena)biosphere reserve / Key Biodiversity Area

    Islets about 22 km south-west of Principe; the largest seabird colonies in the Gulf of Guinea and a Ramsar/Key Biodiversity Area within the Principe Biosphere Reserve. Surrounding waters are part of the Biosphere Reserve and within the scope of the 2025 MPA initiative; conservation-restricted. Exact statutory fishing prohibition boundaries were not retrievable. Coordinates are the central coordinates of the KBA as listed by the Key Biodiversity Areas database; they locate the site, not a precise legal prohibition boundary.

  • Parque Natural Obô do Príncipemarine and coastal national/natural park

    The Obô Natural Park of Príncipe, designated a National Natural Park in 2006, is recorded in the World Database on Protected Areas (WDPA ID 555592842) as a 'Marine and Coastal Protected Area' covering ~45 km2 on and around Príncipe island. It is a legally established protected area; under Lei n.º 9/2022 (Art. 15 typology of marine protected areas; Art. 137 — fishing inside protected/reserved marine areas is a very serious infraction) fishing and other prohibited activities are restricted within protected-area boundaries. Coordinate is the island/park reference point on Príncipe; it locates the site, not a precise legal fishing-prohibition boundary.

Spearfishing falls under the general 'pesca amadora' (amateur fishing) category created by Lei n.º 9/2022 and reinforced by the 2025 amendment (Lei n.º 07/2025). That category is licence-exempt but requires authorisation and registration; detailed operational rules (gear, methods, areas, catch limits) are delegated to a Regulamento da Pesca Amadora (Art. 13(2)(f)) that had NOT been published as of the latest consulted source, hence many operational fields are marked unknown rather than guessed.
