Eswatini

Africa · Southern Africa

Eswatini is landlocked, so there is no marine spearfishing; only inland freshwater fishing (rivers and dams) is possible. No statute or regulation names 'spearfishing' / underwater fishing specifically. Inland fishing is governed by the Fisheries and Aquaculture Act, 2019 (Act 16/2019), which repealed and replaced the Protection of Fresh Water Fish Act No. 75 of 1937. Under the 2019 Act, anyone undertaking commercial or sport (recreational) fishing needs a fishing licence issued by the Fisheries and Aquaculture Board plus a fishing permit issued by the Principal Secretary; subsistence fishers and fish farmers are exempt from the licence. The Minister may, by Gazette notice, declare specific fishing practices to be 'prohibited fishing practices' (section 19), so the legality of any particular method such as spearing depends on Ministerial declarations and on individual permit conditions rather than on an explicit statutory ban. The 2019 Act's general commencement is to be proclaimed by the Minister by Gazette notice, creating some uncertainty over which provisions are already in force. In practice, tourism authorities advise that a fishing permit or rod fee is required, and most fishing is fly fishing / angling for trout, bass, bream, yellowfish and (seasonally) tiger fish.

Catatan peneliti

Eswatini (formerly Swaziland) is LANDLOCKED (no sea coastline), so marine spearfishing does not apply; any spearfishing would be in inland rivers/dams. No Eswatini statute or regulation located names 'spearfishing'/underwater fishing explicitly, so its legality is not directly answered in law. The governing instrument is the Fisheries and Aquaculture Act, 2019 (Act 16/2019), which repealed the Protection of Fresh Water Fish Act No. 75 of 1937 (s.49). All verbatim law_texts come from the official FAOLEX PDF of Act 16/2019 (swa232765.pdf), which was downloaded and text-extracted with pdftotext. IMPORTANT CAVEAT: Act 16/2019 carries 'Date of Assent: 29 October 2019' and 'Date of commencement to be proclaimed' (s.1(2)) - i.e., it comes into force on a date set by Ministerial Gazette notice. It was not possible from the retrieved sources to confirm whether commencement has been proclaimed, so there is residual uncertainty about which sections are currently operational. Status set to 'restricted' (rather than yes/no) because recreational fishing is permitted but gated behind a licence + permit regime, and specific methods (including spearing) can be declared prohibited by Gazette notice under s.19 and constrained by permit conditions. data_confidence=medium: the statutory framework is from a primary official source and verbatim, but spearfishing-specific rules, current Gazette notices, fees, closed seasons, catch/size limits and protected-species lists could not be located. The Swaziland National Trust Commission legislation site (sntc.org.sz) refused HTTP connections during research; the FAOLEX country-profile HTML returned 403 but the underlying Act PDFs were retrievable. Coordinates for Maguga Dam, Malolotja Nature Reserve and Van Eck/Hawane are approximate well-known locations; treat as indicative.
