Recreational spearfishing is illegal throughout the Turks and Caicos Islands. Under the Fisheries Protection Regulations (Cap. 104), it is an offence to be in possession of a spear gun anywhere within the fishery limits (or within fifty feet of any tidal water, on any beach or foreshore, while swimming, or in any vessel). Hawaiian slings may only be used by holders of a commercial fishing licence, so no recreational spear of any kind is permitted. Taking marine products with scuba equipment is also prohibited except under a specially endorsed licence. The single exception is the invasive lionfish: lionfish are the only species that may be legally speared recreationally, the only marine product that may be taken with scuba gear, and the only product that may be taken inside national parks and nature reserves — and only under a lionfish licence issued by the Department of Environment and Coastal Resources / Department of Fisheries and Marine Resources Management. Penalties for breach are up to a $50,000 fine and/or twelve months' imprisonment.

(h) A Sports Fishing Licence: authorising the holder to engage in fishing in any area of the fishery limits and: to retain in any one day's fishing for consumption by the holder of the licence or in the home of the holder of the licence marine products not exceeding ten pounds (10 lbs) in weight in total; and to retain during the term of the licence as a trophy one fish of unlimited size or such greater number of fish as the Chief Fishery Officer acting in his discretion shall in writing deem reasonable.

(1) The close season in relation to crawfish shall be the period from the first day of April to the thirty-first day of July (inclusive) in each year or such other dates as may, from time to time, be appointed by the Governor in the Gazette. (2) Without prejudice to paragraph (1), the Governor may, by notice in the Gazette, appoint any period to be a close season for any particular species of marine product, either generally or in any particular area or areas.

14. (1) Any person who takes or is in possession of or sells any marine product smaller than the legal size shall be guilty of an offence ... (2) For the purpose of this regulation the legal size means, in relation to — (a) Crawfish (i) when whole, a length of 3.75 inches measured from the front of the groove between the horns directly above the eyes along the middle of the back to the rear edge of the carapace or back shell; or (ii) when the tail has been separated, a tail weight of 7 ounces whether processed or not. (b) Conch (i) a minimum shell length of 7 inches measured from the spiral tip to the foremost edge; and (ii) a conch meat, when removed from the shell, of a total weight of 8 ounces after the removal of the digestive gland. (c) Turtles (i) Hawksbill Turtle (Eretmochelys imbricata) a shell measurement of 20 inches in length ... and a weight of at least 20 lbs; (ii) Green Turtle (Chelonia mydas) a shell measurement of twenty inches in length ... and a weight of at least 20 lbs; (iii) Any other turtle, a weight of at least 20 lbs.

Prohibited areas

(1) The Minister may, by notice in the Gazette, declare any area to be a prohibited area — (a) for the taking of any particular or all species of marine products or for the depositing of any conch shells or any other matter whatsoever; or (b) for the taking of any particular or all species of marine products by particular means; or (c) into which a vessel licensed under regulation 6 shall not enter. (2) The Minister may, by notice in the Gazette: (a) prohibit, restrict or regulate the taking, capturing, killing or destroying of any kind or species of marine product within the fishery limits of the Turks and Caicos Islands either generally or at any particular time or within any particular area; (b) restrict, regulate or control the methods and apparatus used in connection with the taking ... of any species of marine product.

  • Bang sticks (firearm-tipped spears) fall within prohibited apparatus definitions.
  • It is an offence to break, remove or damage any coral reef or marine plant within the fishery limits (Reg. 9(1)(h)).

Net or trap use is additionally prohibited in Bell Sound (South Caicos). Penalty for equipment/method offences is up to a $50,000 fine and/or 12 months' imprisonment.

Size limits in the law are stated in inches/ounces; cm values here are converted from the inch figures in Regulation 14 (3.75 in carapace = 9.5 cm; 7 in shell = 17.8 cm; 20 in turtle shell = 50.8 cm). Crawfish also carries a 7 oz separated-tail-weight alternative; conch an 8 oz meat-weight minimum. Selling crawfish meals in restaurants/hotels during the close season is prohibited. None of these directly authorise spearfishing, which remains banned.

  • Non-Belongers may not take marine products for recreation without a licence (the Belonger recreational exemption in Reg. 4(2)(a) does not extend to non-Belongers).
  • Visitors who wish to do legal (line/rod) recreational fishing need a Sports Fishing Licence; charters often arrange this.
  • A lionfish licence (the only route to any spearing) can in practice only be bought in person at the Department of Fisheries and is reported to be difficult to obtain for short-term visitors.

  • Recreational spearfishing is prohibited for everyone, residents and foreigners alike — spear-gun possession is an offence within the fishery limits.
  • Non-Belonger commercial licence holders may only take marine products while using a trap or diving boat owned by a Belonger (Reg. 7(3)(d)).

There is no licence category that permits a foreign visitor to spearfish for general species. Foreigners are limited to line/rod sports fishing under a Sports Fishing Licence, or (in theory) lionfish removal under a lionfish licence.

Fishing, motorized boating and collecting are prohibited; lionfish (under licence) is the only marine product that may be taken inside national parks and nature reserves.

  • Columbus Landfall National Park (NP6)national park / marine reserve

    Marine national park along the western coast of Grand Turk. Fishing and collecting of marine products are prohibited (lionfish under licence excepted).

  • Marine national park on the north-western tip of Providenciales protecting reef and wall dive sites. Fishing and collecting prohibited (lionfish under licence excepted).
