Recreational and subsistence spearfishing is legal in Fiji and is one of the few methods that does not require a fishing licence: under the Fisheries Act (Cap 158) s.5(3)(a) a person who takes fish with a spear (or a line from the shore) need not hold a licence, and people may fish for subsistence with such gear anywhere in Fiji. However, it is heavily restricted by gear and area rules. Using any underwater breathing apparatus (scuba, compressors, hookah) to take, collect or dive for fish is banned nationwide under the Fisheries (Restrictions on Use of Breathing Apparatus) Regulations 1997 (reg 4), so spearfishing must be done on breath-hold only unless an exemption is granted by the Permanent Secretary. Use of explosives or poisons (derris/rotenone, chemicals) to take fish is a criminal offence. Sea turtles are fully protected under a national moratorium and cannot be taken by any means. Most inshore waters fall within registered customary fishing grounds (qoliqoli); subsistence spear fishers from the owning community do not need permission, but visitors and anyone fishing commercially require a licence, the chief's/community consent, and must avoid community no-take (tabu) areas and marine protected areas. Minimum size limits and protected-species rules (giant clams, trochus, triton, humphead wrasse, beche-de-mer) apply to all fishers including spear fishers.

Daily bag limits for general reef fish are not set out as a single national figure; community/qoliqoli rules may impose limits.

Fishing was banned entirely in 1997 by the Kubulau community/qoliqoli owners; the area is a full no-take zone managed jointly with dive operators (voluntary dive-tag access for swimming/diving only). All extractive fishing, including spearfishing, is prohibited.

  • Shark Reef Marine Reserve (Beqa Passage)no-take marine protected area / national marine park

    A ~1.5 km patch reef in Beqa Passage off Pacific Harbour, southern Viti Levu, established as a full no-take Marine Protected Area in April 2004 by Beqa Adventure Divers with the Fiji Department of Fisheries and the traditional owners of Galoa and Wainiyabia villages, who gave up their right to fish the area. Designated Fiji's first National Marine Park in 2014. All fishing including spearfishing is prohibited.

  • Vatu-i-Ra Conservation Parkno-take marine conservation park / tabu

    A conservation park established around Vatu-i-Ra island and over 100 km2 of reefs of the Vatu-i-Ra Passage (Bligh Water), off the northern coast of Viti Levu, Ra Province, within the qoliqoli of Cokovata Nakorotubu. Per WCS, nearly 80% of the park (including all of Vatu-i-Ra island, where the pinned point sits) is a designated 'no-take' zone closed to all fishing including spearfishing; the remaining ~20% is a catch-and-release zone. (Note: the proposal's '110.5 km2', '2017' establishment and 'full no-take' claims are not confirmed by the cited source, which states 'over 100 km2' and ~80% no-take.)
