Recreational spearfishing (pesca con arpon en apnea) is legal in Puerto Rico but tightly regulated. In Puerto Rico jurisdictional (territorial) waters it is governed by the DRNA Reglamento de Pesca de Puerto Rico. Spearfishing is allowed only while freediving/breath-hold (en apnea): it is illegal to use a speargun and a diving tank (SCUBA) at the same time. Spear-fishing is prohibited at docks, designated bathing areas, marine reserves and artificial reefs, prohibited at night (sunset to sunrise), and prohibited within 100 feet (30.48 m) of the coast where the spear must be kept unloaded. A recreational saltwater fishing license from DRNA is required for anyone 13 or older. In adjacent federal waters (the EEZ around Puerto Rico, generally beyond 9 nm) NOAA / 50 CFR 622 applies: powerheads may not be used to take reef fish, Nassau and goliath grouper, three parrotfish species, queen conch and certain rays are fully protected, and several spawning-area and species seasonal closures apply.

Recreational spearfishing in Puerto Rico is essentially a freediving activity. Spearfishing on SCUBA is not permitted. Equipment commonly used: speargun (arpon/fusil), mask, snorkel, fins, weight belt, dive knife.

Reef fish below the legal sizes in the regulation's size appendix must be released. Territorial minimum sizes above (yellowtail snapper 10.5 in, snook 22 in, queen conch 9 in shell, spiny lobster 3.5 in carapace) are confirmed against current DRNA / Sea Grant PR guidance and converted to cm. Federal minimum sizes (dolphinfish 24 in, wahoo 32 in fork length) are from NOAA Amendment 3. Earlier unverified figures (a silk-snapper minimum and a snook upper slot limit) were removed pending a primary-source citation. Verify exact current figures against the DRNA Reglamento Num. 7949 size appendix and current 50 CFR 622 rules before fishing.

  • Non-resident U.S. citizens and foreign visitors fishing recreationally in Puerto Rico jurisdictional waters must hold a DRNA recreational fishing license.
  • Foreign visitor license fee: USD 50/year, USD 10 for 7 days, or USD 7 for 1 day.
  • Non-resident U.S. citizen license fee: USD 35/year, USD 7 for 7 days, or USD 5 for 1 day.

No additional special permit beyond the standard non-resident/visitor recreational license. In federal EEZ waters no recreational fishing license is currently required, but federal 50 CFR 622 gear/species/closure rules apply.

  • Spearfishing while freediving (en apnea) is permitted in Puerto Rico jurisdictional waters outside marine reserves, designated bathing areas, docks/marinas and artificial reefs, during daylight only. Within 100 feet (30.48 m) of the coast spearfishing is prohibited and the spear must be kept unloaded.

  • No-take natural reserve at the Luis Pena Channel, Culebra, delimited by geographic coordinates in the regulation; fishing prohibited.

  • Fishing for aquatic/semi-aquatic organisms prohibited within Laguna del Condado, excluding the San Antonio Channel.

  • Federal EEZ reef bank west of Mayaguez. Reef fishing prohibited Oct 1 - Mar 31; anchoring by fishing vessels prohibited year-round; year-round prohibition on pots, traps, bottom longlines, gillnets and trammel nets. Powerheads prohibited for reef fish throughout the EEZ.

  • Federal EEZ closed area: all fishing prohibited Dec 1 - end of February; year-round ban on pots, traps, bottom longlines, gillnets and trammel nets. Bounded by 18 06.5'N/67 26.9'W, 18 06.5'N/67 23.9'W, 18 03.5'N/67 23.9'W, 18 03.5'N/67 26.9'W.

  • Federal EEZ closed area (EEZ portions): all fishing prohibited Dec 1 - end of February; year-round ban on pots, traps, bottom longlines, gillnets and trammel nets. Bounded by 18 11.2'N/67 22.4'W, 18 11.2'N/67 19.2'W, 18 08.2'N/67 19.2'W, 18 08.2'N/67 22.4'W.

  • No-take marine reserve off the coast of Ensenada/Puntas barrios in Rincon, on Puerto Rico's west coast, covering the Tres Palmas / Steps Beach elkhorn-coral reef (~1,200-1,400 acres, 3.8 km perimeter). Fishing (which includes spearfishing) and anchoring are prohibited inside the reserve boundaries, and removing shells or dead coral is banned under its no-take regulation. Designated by the Puerto Rico Legislature (Ley Num. 17 of 2004, designation administered by DRNA). Center point is the Tres Palmas / Steps Beach reef from USGS survey data.

  • Coastal coral-reef marine protected area at Punta del Medio, Isla Verde, municipality of Carolina (San Juan metro area), on Puerto Rico's north coast. Designated a marine reserve by Ley Num. 274 of 26 September 2012 and co-managed by DRNA, the Municipality of Carolina and Arrecifes Pro-Ciudad. Fishing (including spearfishing) and the passage of motorized vessels are prohibited within the reserve. Habitat for sea turtles (carey, tinglar), manatees and elkhorn/staghorn coral (Acropora palmata, A. cervicornis).

Puerto Rico is an unincorporated U.S. territory; spearfishing is governed by two layers. (1) Territorial/jurisdictional waters (out to ~9 nm): DRNA Reglamento de Pesca de Puerto Rico. The verbatim Spanish provisions captured here (spearfishing gear/area/night rules, license fee table, mero cabrilla veda, grouper protections, powerhead ban) are from the official Reglamento Num. 6768 (2004) PDF on drna.pr.gov. This regulation was superseded in 2010 by Reglamento Num. 7949, which is the CURRENT in-force local fishing regulation and retains the same core spearfishing rules (apnea-only spearfishing, no speargun+SCUBA tank, 100 ft unloaded-spear rule, marine-reserve and night prohibitions). The 7949 PDF could not be machine-extracted at access time (large PDF / repeated fetch timeouts), so its exact verbatim wording and inciso numbering are not quoted here; where the 2004 numbering is cited it may differ from 7949.
