Recreational sea spearfishing is legal in the UK without a national licence or permit, but only in tidal/marine waters - it is illegal in fresh water (rivers, lakes, canals). Divers must freedive or snorkel; using scuba or surface-supplied air to spearfish is not permitted. Salmon, sea trout, eels and a list of protected/endangered species may not be taken; sea bass is subject to a 42 cm minimum size, a daily bag limit (three fish/day under the MMO guidance current to February 2026), and a February-March catch-and-release (closed) period that effectively bars spearing of bass in those months. Marine protected areas (MCZs/SACs), many harbours, estuaries, marine infrastructure and bathing beaches restrict or prohibit spearfishing. Rules differ between the four UK nations and between local Inshore Fisheries and Conservation Authority (IFCA) districts in England, so local bylaws must always be checked.

Recreational fishing for European sea bass (closed period, bag limit, minimum size)
MMO/Defra Bass Fishing Guidance 2025
Recreational fisheries, including from shore, in ICES divisions 4b, 4c, 6a, 7a and 7d to 7j are limited to catch-and-release using rod and handline only during 1 February to 31 March. Outside of this period, recreational fishers are limited to three fish per day bag limits as agreed in annual negotiations with the EU and amended by The Sea Fisheries (Amendment) Regulations 2026. The minimum size of European seabass is 42 cm. All specimens below this size must be released.
Minimum conservation reference size for European sea bass (42 cm)
Commission Implementing Regulation (EU) 2015/1316 (retained EU law)
By way of derogation from Annex XII to Regulation (EC) No 850/98, the minimum size for sea bass (Dicentrarchus labrax) in Region 2, as defined in Article 2 of that Regulation, shall be 42 cm.
Offence of breaching or interfering with a Marine Conservation Zone (prohibited acts)
Marine and Coastal Access Act 2009 (c. 23)
(1) A person is guilty of an offence under this section if— (a) the person without lawful excuse does a prohibited act, (b) at the time of doing that act, the person knows, or ought to have known, that the feature to which the act relates is in, or forms part of, an MCZ, and (c) the act has significantly hindered, or may significantly hinder, the achievement of the conservation objectives stated for the MCZ. (2) For the purposes of subsection (1), a person does a prohibited act if the person— (a) intentionally or recklessly kills or injures any animal in an MCZ which is a protected feature of that MCZ, (b) intentionally picks or collects, or intentionally or recklessly cuts, uproots or destroys, any plant in an MCZ which is a protected feature of that MCZ, (c) intentionally or recklessly takes anything from an MCZ which is, or forms part of, a protected feature of that MCZ, or (d) intentionally or recklessly destroys or damages any habitat or feature which is a protected feature of an MCZ.
IFCA power to make byelaws restricting or prohibiting fishing
Marine and Coastal Access Act 2009 (c. 23)
Section 153: The authority for an IFC district must manage the exploitation of sea fisheries resources in that district. ... Section 155(1): For the purposes of performing the duty imposed by section 153 or the duty imposed by section 154, the authority for an IFC district may make byelaws for that district. ... Section 156(1): The provision that may be made by a byelaw under section 155 includes provision falling within any one or more of the Heads set out in— (a) subsection (3) (prohibition or restriction of exploitation of sea fisheries resources), (b) subsection (4) (permits), (c) subsection (5) (vessels, methods and gear), (d) subsection (6) (protection of fisheries for shellfish), (e) subsection (7) (monitoring of exploitation of resources); (f) subsection (8) (information). Section 156(3): Head 1 is provision prohibiting or restricting the exploitation of sea fisheries resources. [Byelaws under these Heads are the powers under which IFCA minimum-size, no-take and method byelaws affecting spearfishing are made.]
Protection of certain wild animals (offence to kill, injure or take a Schedule 5 species)
Wildlife and Countryside Act 1981 (c. 69)
Subject to the provisions of this Part, if any person intentionally kills, injures or takes any wild animal included in Schedule 5, he shall be guilty of an offence. [Schedule 5 protected marine species include the short-snouted and spiny (long-snouted) seahorses and the angel shark (Squatina squatina); taking them by spear is therefore an offence.]
Scotland: freshwater fish may be taken only by rod and line (spear prohibited)
Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003 (asp 15)
(1) Subject to subsections (3) and (4) below, any person who fishes for or takes freshwater fish in any inland waters except by rod and line shall be guilty of an offence, and liable on summary conviction to a fine not exceeding level 4 on the standard scale. ... (3) In any pond or loch where all the owners are agreed, a right of fishing may be exercised by net. (4) In any inland waters an owner or occupier may fish for or take freshwater fish, other than trout, by net or trap. [Because the only lawful recreational method is rod and line, spearfishing for freshwater fish in Scottish inland waters is an offence.]

Uitrustingsregels
Welke uitrusting is toegestaan, hoe die gebruikt mag worden en welke voorwaarden eraan verbonden zijn.
Beperkingen
- Must freedive or snorkel; spearfishing while using scuba (aqualung) or surface-supplied air is not permitted
- Spearguns are legal to own and use for fishing in the sea, but carrying a loaded/assembled speargun in a public place on land may constitute an offensive weapon
- Spear/gaff and similar instruments are prohibited for taking salmon, trout, eels and freshwater fish (Salmon and Freshwater Fisheries Act 1975 s.1)
Recreational spearfishing is by breath-hold diving only. Daytime is the practical/safe norm; under Theft Act 1968 Sch.1 reduced penalties apply only to daytime angling in private waters (one hour before sunrise to one hour after sunset). Secondary spearfishing guidance commonly states daylight (dawn-to-dusk) only.

ToegestaanBeperkingen
- Same rules as residents: sea/tidal waters only, freediving only, species/size/bag limits, MPA and local IFCA bylaw compliance
- Spearguns must be transported in checked baggage (not hand luggage) per airline and customs rules
No nationality-based restriction for recreational sea spearfishing. Visitors must comply with the same fisheries and conservation rules as residents and check local IFCA bylaws.
Inwoners
No spearfishing-specific licence; free IFCA shellfish/inshore permit where applicable
Vereisten
- Comply with marine fisheries rules, minimum sizes, bag limits and MPA restrictions
- Obtain relevant IFCA shellfish permit if required for the target shellfish/area
Rules are broadly the same for residents and visitors. Note Scotland and Northern Ireland have separate fisheries regimes; the Scottish Government confirms 'Scotland does not have fishing licences for recreational fishing' (so no recreational sea licence is needed), but under s.2 of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003 freshwater fish in inland waters may be taken only by rod and line (spearfishing prohibited), and targeting migratory species (salmon/sea trout) requires the legal right or written permission.

Toegestane gebieden
Recreational spearfishing is permitted in tidal sea waters around the UK coast, by freediving or snorkelling, subject to species rules, size and bag limits, MPA exclusions and local IFCA bylaws. No national spearfishing licence is required for sea fish.
Sea/tidal water only (freshwater banned); no scuba or surface-supplied air; protected species and minimum sizes apply; avoid MCZs/SACs, harbours, estuaries, marine infrastructure and designated bathing beaches; check local IFCA bylaws.
Verboden gebieden
- Fresh waters (rivers, lakes, canals)statutory prohibition (freshwater)
Spearfishing is illegal in fresh water throughout the UK. Under the Salmon and Freshwater Fisheries Act 1975 a spear is a prohibited instrument for taking salmon, trout, eels and freshwater fish.
- Marine Conservation Zones (MCZs) and Special Areas of Conservation (SACs)marine protected area
Under s.140 of the Marine and Coastal Access Act 2009 it is an offence to intentionally or recklessly kill, injure or take an animal that is a protected feature of a Marine Conservation Zone (where the act may significantly hinder the MCZ's conservation objectives). Spearfishing is therefore restricted or prohibited within designated MCZs (and equivalent Nature Conservation MPAs in Scotland, plus SACs/SPAs UK-wide). Specific site byelaws must be checked.
- Harbours, estuaries, marine infrastructure and designated bathing beacheslocal byelaw / safety zone
Many harbours, estuaries, marina/marine infrastructure areas and bathing beaches prohibit spearfishing under local byelaws for safety or wildlife reasons.
- Lundy No Take Zone (Lundy MCZ)no-take marine protected area
The UK's first statutory No Take Zone, designated on 10 January 2003 by a Devon Sea Fisheries Committee byelaw (now regulated by Devon & Severn IFCA) on the east (sheltered) side of Lundy Island in the Bristol Channel, covering about 3.3 km2 within the Lundy Marine Conservation Zone. The official MPA management body states that within the NTZ 'extraction of anything is prohibited', so all fishing and removal of marine life - including spearfishing - is banned.
- Lamlash Bay No Take Zone (Isle of Arran)no-take marine protected area
Scotland's first community-led No Take Zone, established 2008 in Lamlash Bay on the south-east coast of the Isle of Arran (Firth of Clyde), covering about 2.67 km2 of waters, seabed and shore. No fish or shellfish (and therefore no spearfishing) may be taken; it now sits within the wider South Arran MPA.
- Flamborough Head No Take Zoneno-take marine protected area
A 1 km2 No Take Zone established in 2010 on the south side of Flamborough Head, East Yorkshire (North Sea), stretching from the Bridlington edge of Danes Dyke to Sewerby Steps and extending 700 m seaward from the cliff base. Removal of any sea fish is prohibited, so spearfishing is banned. Managed under a North Eastern IFCA byelaw.

Notities van de onderzoeker
Spearfishing is treated under several overlapping legal regimes rather than one dedicated statute. The core legality is now backed by verbatim primary law on legislation.gov.uk: (1) sea spearfishing is legal with no national licence; (2) freshwater spearfishing is prohibited - in England and Wales a spear is a prohibited instrument under s.1 of the Salmon and Freshwater Fisheries Act 1975 (which by s.1(3A) extends to inshore waters out to 6 nm), and in Scotland s.2 of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003 allows freshwater fish to be taken only by rod and line; (3) the sea bass 42 cm minimum size is set by Commission Implementing Regulation (EU) 2015/1316 Art.1 (retained EU law), and the three fish/day recreational bag limit and Feb-Mar catch-and-release are from the official MMO bass guidance current to February 2026; (4) Marine Conservation Zone restrictions rest on s.140 of the Marine and Coastal Access Act 2009, and IFCA byelaw powers (minimum sizes, no-take and method byelaws) on ss.153-156 of the same Act; (5) protected marine species (seahorses, angel shark) are protected by s.9 of the Wildlife and Countryside Act 1981. The more granular per-district IFCA size lists and shellfish daily caps still vary by district and are best verified against each IFCA's own byelaw; a residual community source (Spearfishing UK / British Spearfishing Association) is retained for the general 'sea-legal' framing and the practitioner-facing IFCA species list. Rules vary significantly by IFCA district and between England, Wales, Scotland and Northern Ireland; divers must verify current local byelaws. Inland/freshwater spearfishing: prohibited in all inland/freshwater bodies throughout the United Kingdom - rivers, lakes, canals, and reservoirs - under SAFFA 1975 s.1 (England and Wales) and the Scotland 2003 Act s.2 (Scotland); no named exceptions exist for recreational use.
