Recreational spearfishing (pesca con arpon en apnea) is legal in Puerto Rico but tightly regulated. In Puerto Rico jurisdictional (territorial) waters it is governed by the DRNA Reglamento de Pesca de Puerto Rico. Spearfishing is allowed only while freediving/breath-hold (en apnea): it is illegal to use a speargun and a diving tank (SCUBA) at the same time. Spear-fishing is prohibited at docks, designated bathing areas, marine reserves and artificial reefs, prohibited at night (sunset to sunrise), and prohibited within 100 feet (30.48 m) of the coast where the spear must be kept unloaded. A recreational saltwater fishing license from DRNA is required for anyone 13 or older. In adjacent federal waters (the EEZ around Puerto Rico, generally beyond 9 nm) NOAA / 50 CFR 622 applies: powerheads may not be used to take reef fish, Nassau and goliath grouper, three parrotfish species, queen conch and certain rays are fully protected, and several spawning-area and species seasonal closures apply.

Trawl, trammel net, and purse seine gear are prohibited for use to fish in the EEZ around Puerto Rico. [...] (a) Reef fish [...] (1) Poisons. Recreational spearfishing in Puerto Rico is essentially a freediving activity. Spearfishing on SCUBA is not permitted. Equipment commonly used: speargun (arpon/fusil), mask, snorkel, fins, weight belt, dive knife.

Reef fish below the legal sizes in the regulation's size appendix must be released. Territorial minimum sizes above (yellowtail snapper 10.5 in, snook 22 in, queen conch 9 in shell, spiny lobster 3.5 in carapace) are confirmed against current DRNA / Sea Grant PR guidance and converted to cm. Federal minimum sizes (dolphinfish 24 in, wahoo 32 in fork length) are from NOAA Amendment 3. Earlier unverified figures (a silk-snapper minimum and a snook upper slot limit) were removed pending a primary-source citation. Verify exact current figures against the DRNA Reglamento Num. 7949 size appendix and current 50 CFR 622 rules before fishing.

Puerto Rico is an unincorporated U.S. territory; spearfishing is governed by two layers. (1) Territorial/jurisdictional waters (out to ~9 nm): DRNA Reglamento de Pesca de Puerto Rico. The verbatim Spanish provisions captured here (spearfishing gear/area/night rules, license fee table, mero cabrilla veda, grouper protections, powerhead ban) are from the official Reglamento Num. 6768 (2004) PDF on drna.pr.gov. This regulation was superseded in 2010 by Reglamento Num. 7949, which is the CURRENT in-force local fishing regulation and retains the same core spearfishing rules (apnea-only spearfishing, no speargun+SCUBA tank, 100 ft unloaded-spear rule, marine-reserve and night prohibitions).
