Ghanaian fisheries law does not mention recreational spearfishing, spearguns or harpoons by name, and a hand-thrown spear or speargun is not among the harvesting methods banned outright (explosives, poisons/noxious substances, light attraction, bamboo aggregation, pair-trawling). But Ghanaian law does recognise and regulate recreational fishing as a category: the Fisheries Act, 2002 (Act 625) required a recreational-fishing licence from the Fisheries Commission (s. 60) and the Fisheries and Aquaculture Act, 2025 (Act 1146) carries the same definition of 'recreational fishing' (fishing for leisure, not for subsistence, barter or sale) and treats recreational fishing vessels as a regulated category in the inshore exclusion zone (s. 40). Under Act 1146 it is an offence to use a Ghanaian fishing vessel or canoe for fishing without registering with the Commission and holding a licence (s. 56), with parallel prohibitions for inland (s. 67) and coastal (s. 72) waters; whether a purely shore-based diver without a vessel falls under s. 56 is not spelt out. Ghana's first marine protected area, the Greater Cape Three Points marine fisheries reserve (703 km2, declared 14 April 2026 under Act 1146 s. 39), bans all fishing without the Minister's written permission in its core zone. Because no source explicitly addresses recreational underwater hunting, the practical status is treated as restricted/uncertain: licence, protected-species, minimum-landing-size, closed-season and MPA-zone rules all apply and must be checked with the Fisheries Commission before diving.

Prohibited fishing methods (use of explosives, poison or noxious substances)
Fisheries Act, 2002 (Act 625)
88. (1) A person shall not (a) permit to be used, use or attempt to use any explosive, poison or other noxious substance for the purpose of killing, stunning, disabling or catching fish, or in any way rendering fish more easily caught; or (b) carry on board or have in his or her possession or control without lawful authority at any place within a two kilometre radius from any shore or river, any explosive, poison or other noxious substance in circumstances indicating an intention of using such substance for any of the purposes referred to in paragraph (a). (2) Any explosive, poison or other noxious substance found on board a fishing vessel shall be presumed, unless the contrary is proved, to be intended for the purposes referred to in subsection (1)(a). [Section 88 of Act 625 is titled 'Prohibited fishing methods'; a hand spear, speargun or harpoon is NOT among the methods listed here. Prohibited fishing methods
Fisheries Regulations, 2010 (L.I. 1968)
Prohibited fishing methods. 11. (1) A person shall not within the fishery waters of this country (a) use any fishing method that aggregates fish by light attraction including use of portable generator, switchboard, bulbs beyond 500 watts or bulbs whose cumulative light intensity attracts fish and long cable to facilitate light production or any other contrivance for the purpose of aggregating fish by light; (b) use bamboo for the purpose of aggregating fish; (c) use explosives, obnoxious chemicals and any other prohibited fishing methods which render fish more easily caught; or (d) operate pair-trawling. (2) A person shall not operate any fishing activity within the areas designated as oil and gas exploration installations... (3) A person who contravenes sub-regulation (1) or (2) commits an offence and is liable on summary conviction to the fine specified in section 88(3) of the Act. [A spear, speargun or harpoon is NOT among the prohibited methods. Verbatim text obtained by OCR of the official FAOLEX PDF of L.I. 1968.]
Licence for aquaculture and recreational fishing
Fisheries Act, 2002 (Act 625)
Licence for aquaculture and recreational fishing. 60. (1) An application for a licence for an aquaculture project or recreational fishing shall be made to the Commission and shall be accompanied with an environmental impact assessment. (2) The application shall be in such form as determined by the Commission and shall be accompanied with such fee as the Commission shall determine. ... (8) Recreational fishing shall be carried on in accordance with such requirements as may be prescribed by Regulations. ['recreational fishing' is defined in the interpretation section of Act 625 as 'any fishing done for leisure and not for the purpose of subsistence, barter or sale of fish'; recreational spearfishing would fall within this category, so a recreational-fishing licence from the Fisheries Commission applies. Verbatim text obtained by OCR of the official Act 625 PDF published by Ghana's Ministry of Fisheries and Aquaculture.]
Prohibition of fishing or fishing-related activities without a fishing licence
Fisheries and Aquaculture Act, 2025 (Act 1146)
Prohibition of fishing or fishing-related activities without a fishing licence. 56. (1) A person shall not use a Ghanaian fishing vessel, a bare-boat or a canoe for fishing or fishing-related activities in the fishery waters of the Republic unless that person is (a) registered with the Commission as an owner or a charterer of a fishing vessel; and (b) issued with a fishing licence for that purpose under this Act. (2) A person shall not fish or attempt to fish within the fishery waters of the Republic using a foreign fishing vessel or a chartered foreign fishing vessel unless that person (a) has a fishing licence or authorisation issued in accordance with this Act; (b) is authorised under an access agreement... ['recreational fishing' is separately defined in Act 1146 as 'fishing which is undertaken for leisure and not for the purpose of subsistence, barter or sale of fish'. Marine fisheries reserve (legal basis for the Greater Cape Three Points MPA)
Fisheries and Aquaculture Act, 2025 (Act 1146)
Marine fisheries reserve. 39. (1) The Minister shall, on the advice of the Commission and after consultation with relevant organisations, agencies, owners of the adjoining land, the relevant District Assembly and other stakeholders, declare by notification in the Gazette, an area of the fishery waters and the seabed underlying the waters to be a marine fisheries reserve. (2) The advice under subsection (1) shall be based on a scientific assessment. (3) A person shall not, except with the written permission of the Minister, (a) engage in fishing, (b) dredge or take sand or gravel, or (c) otherwise disturb the natural habitat within a marine fisheries reserve. [This is the provision under which Ghana declared its first marine protected area, the Greater Cape Three Points reserve, on 14 April 2026 — all fishing inside is prohibited without the Minister's written permission. Verbatim text obtained by OCR of the official Act 1146 PDF.]
Closed season
Fisheries and Aquaculture Act, 2025 (Act 1146)
Closed season. 47. (1) The Minister may, by notice in the Gazette, based on verifiable scientific information, declare a closed season, including the duration of the closed season, for fishing in specified areas of the marine waters, inland waters or the riverine system. (2) A declaration under subsection (1) shall be (a) made at least three months in advance of the closed season, (b) given reasonable publicity, and (c) published in a newspaper of nationwide circulation. ... (4) A person who engages in fishing during a closed season declared in accordance with this section commits an offence... (5) The Minister may, in furtherance of subsection (1), impose a ban on fishing activities for a specific number of days, specific fishery waters and specific water bodies as the Minister may determine. [Verbatim text obtained by OCR of the official Act 1146 PDF.]

(1) A person shall not fish for endangered, threatened or protected species in the fishery waters of the Republic unless with written authorisation from the Commission, in consultation with the Water Resources Commission and the Wildlife Division of the Forestry Commission. ... (3) An endangered, threatened or protected species caught accidentally shall be released immediately and returned to the waters from which the endangered, threatened or protected species was taken with the least possible injury. [Verbatim text obtained by OCR of the official Act 1146 PDF.]

Fishing licences are issued by the Fisheries Commission. Ghanaian law recognises recreational fishing as a licensed category: Act 625 s. 60 required an application to the Commission for a recreational-fishing licence (accompanied by an environmental impact assessment), with recreational fishing 'carried on in accordance with such requirements as may be prescribed by Regulations'; Act 1146 carries the same definition of recreational fishing and, under s. 56, makes it an offence to use a Ghanaian fishing vessel or canoe for fishing without registering with the Commission and holding a licence (with parallel inland s. 67 and coastal s. 72 prohibitions). Licence renewal uses Form C of the Fisheries Regulations, 2010 (L.I. 1968), reg. 23, on payment of the prescribed fee. No recreational-angler or spearfishing-specific licence product, fee or validity period was found in the sources reviewed; prospective spearfishers should contact the Commission directly.

محدودیتونه
- Explosives, poisons and other noxious substances are prohibited for catching fish (Fisheries Act 2002, s. 88).
- Light-attraction fishing (portable generators, switchboards, bulbs over 500 watts), bamboo fish aggregation, obnoxious chemicals and pair-trawling are prohibited (Fisheries Regulations 2010, reg. 11).
- Fishing gear with a mesh size less than 25 mm (stretched diagonal length) may not be manufactured, imported, sold or used (Fisheries Regulations 2010, reg. 10).
No Ghanaian instrument reviewed (Fisheries Act 2002 Act 625, Fisheries and Aquaculture Act 2025 Act 1146, or Fisheries Regulations 2010 L.I. 1968 — all read by OCR of their official PDFs) explicitly authorises or prohibits spearguns, hand spears, harpoons or the use of SCUBA for fishing. None of these three instruments mentions the words spear, speargun, harpoon, scuba or diving. Their legality is therefore not directly established in law; absence of an explicit ban does not guarantee permission given the general licence requirement, protected-species and minimum-size rules, and MPA/closed-season zoning.

- Greater Cape Three Points Marine Protected Area (marine fisheries reserve)marine protected area
Ghana's first-ever marine protected area: 703 km2 of ocean and nearshore waters in the greater Cape Three Points area, Western Region (Gulf of Guinea), declared on 14 April 2026 (announced at Busua by the Vice President; led by the Ministry of Fisheries and Aquaculture). Its legal basis is the 'marine fisheries reserve' provision of the Fisheries and Aquaculture Act, 2025 (Act 1146) s. 39, under which a person shall not engage in fishing within the reserve except with the written permission of the Minister. It is zoned into a core zone where no fishing is allowed and multiple-use zones where fishing continues but is strictly regulated, with 21 participating coastal communities. Spearfishing in the core/no-take zone is prohibited without ministerial permission; verify zone boundaries with the Fisheries Commission before any underwater fishing.
- Inshore Exclusion Zone (coastal waters)fisheries exclusion zone
Under Fisheries and Aquaculture Act, 2025 (Act 1146) s. 40, the Minister designates an inshore exclusion zone in coastal waters. Per s. 40(2)-(4) a person shall not use an industrial fishing vessel, a large semi-industrial vessel or a canoe support vessel to fish there, nor use towing gear; the zone 'shall be used exclusively by semi-industrial vessels, canoes and recreational fishing vessels' for fishing, fishing-related activities or research with gear prescribed by the Commission. Commentary reports the zone was expanded from 6 to 12 nautical miles. This is a gear/vessel-type exclusion that expressly contemplates recreational fishing vessels rather than a blanket ban on individual divers, but it confirms coastal fishing is regulated and licence-bound. Verbatim s. 40 text is in the law_texts block / Act 1146 PDF.

د څیړونکي یادښتونه
No Ghanaian law, regulation or fisheries-authority source explicitly mentions recreational spearfishing, spearguns or harpoons. This was confirmed against the full official texts of all three governing instruments — Fisheries Act 2002 (Act 625), Fisheries and Aquaculture Act 2025 (Act 1146) and Fisheries Regulations 2010 (L.I. 1968) — each read in this update by OCR of its official/authoritative PDF; the words spear, speargun, harpoon, scuba and diving appear in none of them. Status is set to 'restricted' (not 'yes') because: (1) Ghanaian law recognises and licenses recreational fishing as a category (Act 625 s. 60; same definition retained in Act 1146) and makes unlicensed fishing an offence (Act 1146 s. 56 for Ghanaian vessels/canoes, ss. 67/72 for inland/coastal waters) — though Act 1146 s. 56 is framed around vessels/canoes, so the position of a purely shore-based diver is not spelt out; (2) all fishing inside the new Greater Cape Three Points marine fisheries reserve (703 km2, declared 14 Apr 2026 under Act 1146 s. 39) is prohibited without the Minister's written permission, and the inshore exclusion zone (s. 40) regulates which vessels may fish; (3) protected-species (s. 45), minimum-landing-size (L.I. 1968 reg. 14) and closed-season (s. 47) rules apply to any catch; (4) several harvesting methods are banned but spearfishing is not named, so its specific legality is undetermined. data_confidence raised from 'low' to 'medium': the core provisions are now quoted verbatim from the official Act 625 / L.I. 1968 / Act 1146 PDFs (replacing the earlier secondary-database and arrangement-of-sections citations), and the 2026 closed-season dates and MPA designation are confirmed by the Ministry of Fisheries / GBC. Still unconfirmed: exact recreational-fishing licence cost and validity, any speargun- or SCUBA-specific rule, whether the licence requirement reaches an unequipped shore diver, and precise MPA core-zone boundaries. Anyone intending to spearfish in Ghana should confirm current rules and MPA boundaries directly with the Fisheries Commission (Ministry of Fisheries and Aquaculture).
