Recreational spearfishing is legal in Jamaica but heavily restricted. Under the Fisheries Act, 2018 (s.25) no person may fish in Jamaican fisheries waters without the appropriate licence/authorization from the National Fisheries Authority; the only licence exemptions (Second Schedule) are fishing in a pond on a single private property and fishing 'with a line only, from the river bank or sea shore' - neither covers spearfishing, so spearfishers must be licensed. All fishing (including spearfishing) is prohibited in declared Special Fishery Conservation Areas / fish sanctuaries except under a licence and the Minister's directions: contravention is an offence carrying a fine up to J$1,000,000 or up to 6 months imprisonment (as raised by the 2016 amendment); the Fisheries Act 2018 (s.94) separately makes it an offence to fish in a fish sanctuary 'without lawful authority'. There are at least 17 gazetted conservation areas (14 under the 2012 regulations + East Portland, Boscobel East and Boscobel West added in 2016). The 2018 Act prohibits fishing with explosives, poison, noxious substances or electrical-current devices (s.89). Mechanical spearguns were officially phased out from 31 March 2010 (a government-funded programme replaced them with Hawaiian slings), night diving for spearfishing was banned from the same date, and a special permit is required for compressors / underwater-breathing devices used for fishing. Closed seasons apply to spiny lobster (1 April - 30 June) and queen conch (30 August - 28 February). Spearfishing is widely cited as the single greatest threat to Jamaica's marine biodiversity.

Licence, authorization or permit required to fish; only Second-Schedule methods exempt

25.-(1) Subject to the provisions of this Act, no person shall engage in fishing or any related activity in the fisheries waters or beyond the fisheries waters- (a) without the appropriate licence, authorization or permit granted in accordance with this Act as may be prescribed; (b) contrary to the terms and conditions of an appropriate licence, authorization or permit granted in accordance with this Act or as may be prescribed; and (c) contrary to the provisions of this Act or any Regulations made hereunder. (2) Subsection (1) shall not apply to a person who engages in fishing using any of the methods specified in the Second Schedule. [...] (5) A person who contravenes subsection (1), (3) or (4) commits an offence.

Offences in a fish sanctuary (no fishing without lawful authority)

94.-(1) A person commits an offence where, in a fish sanctuary he- (a) without lawful authority fishes or attempts to fish; (b) places or causes to be placed, any poisonous or noxious substance; (c) uses or causes to be used, any dynamite or other explosive substances; (d) removes, disturbs, or alters any living organism including, but not limited to, seagrass, corals and mangrove; (e) removes any non-living material including but not limited to sand, rocks, coral or other materials; (f) causes or knowingly permits to flow, whether directly or indirectly, any trade effluent or industrial waste, sewage or any noxious or polluting matter; (g) conducts, or causes to be conducted, any research without the permission of the Authority.
Declaration of fish sanctuary; activities may be restricted or prohibited

17.-(1) The Minister may, for the protection of the ecosystem, fisheries resources or in the national interest, from time to time, by order, declare- (a) any area to be a fish sanctuary; or (b) any area or each of the areas around or adjacent to a fish sanctuary to be a buffer zone. (2) An order made under subsection (1) may regulate the activities in a fish sanctuary and a buffer zone and may, subject to such conditions as the Minister, after consultation with the Authority considers appropriate, stipulate any activity in a fish sanctuary or a buffer zone that is restricted or prohibited in the fish sanctuary or buffer zone.
Prohibited fishing methods (explosives, poison, noxious substances, electrical-current devices)

89.-(1) A person commits an offence if that person in the fisheries waters- (a) permits to be used, uses, attempts or participates in the use of any explosive, poison or noxious substance or electrical current fishing device; (b) carries, or has in his possession or control, any explosive, poison, noxious substance or electrical current fishing device; or (c) uses a prohibited fishing method prescribed by this Act.
Power to declare a close season for a fishery or species

23.-(1) The Minister may, by order, in any of the circumstances specified in subsection (2), declare any period to be a close season for any fishery or species of fish.
Fishing prohibited in a Special Fishery Conservation Area except under licence and directions

4.-(1) Subject to paragraphs (2) and (3), no person shall fish in a special fishery conservation area except in accordance with- (a) a licence issued by the Licensing Authority under the provisions of the Act; and (b) the provisions of the directions issued by the Minister under regulation 5. [...] (3) A person who contravenes paragraph (1), commits an offence and is liable on summary conviction before a Resident Magistrate to a fine not exceeding one thousand dollars. [Note: by the 2016 amendment regulations the maximum fine in reg. 4(3) was raised to one million dollars or in default up to 6 months imprisonment, before a Parish Judge.]
2016 amendment - adds East Portland, Boscobel East and Boscobel West SFCAs and raises penalties

2. Regulation 3 of the principal Regulations is amended- [...] (c) by inserting next after paragraph (n), as amended, the following as paragraphs (o), (p) and (q)- "(o) in Part I of the Fifteenth Schedule [...] which shall be known as the East Portland Special Fishery Conservation Area; (p) in Part I of the Sixteenth Schedule [...] which shall be known as the Boscobel East Special Fishery Conservation Area; and (q) in Part I of the Seventeenth Schedule [...] which shall be known as the Boscobel West Special Fishery Conservation Area.". 3. Regulation 4 of the principal Regulations is amended- [...] (b) in paragraph (3), by deleting the words "Resident Magistrate to a fine not exceeding one thousand dollars" and substituting therefor the words "Parish Judge to a fine not exceeding one million dollars and in default of payment to a term of imprisonment not exceeding six months".

Spearfishing remains legal by day under licence using permitted gear (notably Hawaiian slings). The Fisheries Act, 2018 itself does not name 'speargun', 'Hawaiian sling' or 'SCUBA'; the speargun phase-out, night-diving ban and compressor-permit requirement were ministerial fisheries measures announced in 2009 (effective 31 March 2010). A widely-reported clause prohibiting use of any impaling device (speargun/Hawaiian sling) between 6:00 p.m. and 5:00 a.m. (attributed to a 2011 amendment of the former Fishing Industry Act) could NOT be verified against a live primary source - the only citation found (a 2013 Jamaica Gleaner article) is now a dead link (HTTP 404) - so it is recorded here as an unverified report rather than as quoted law; the verifiable position is that night diving for spearfishing is banned.

- Permission is required to fish within marine parks such as Montego Bay Marine Park.

No specific foreigner/tourist spearfishing regime was confirmed in authoritative sources. Tourists are generally expected to fish via licensed charters and are barred from sanctuaries and marine parks; independent confirmation from the NFA is recommended before spearfishing as a visitor.
