Recreational spearfishing (pesca deportiva con arpón / pesca submarina) is legal in Colombia but tightly restricted. It is regulated by AUNAP (Autoridad Nacional de Acuicultura y Pesca) under the recreational-fishing framework set by Resolution 0549 of 2022, issued under the General Fishing Statute (Law 13 of 1990) and Decree 1071 of 2015. A personal AUNAP recreational-fishing permit (carné) is required for nationals and foreigners alike. Spearfishing must be done by free diving in apnea only; per news reporting of the resolution, only one elastic/spring speargun per person is allowed, night spearfishing is prohibited, and hooks, gigs/tridents and light-attraction devices are banned. Recreational fishing must be non-commercial (catch-and-release oriented, with retention only for self-consumption above minimum sizes); selling the catch is prohibited. Spearfishing is banned inside National Natural Parks and other marine protected areas, where the environmental authority (Parques Nacionales Naturales) governs. The resolution rules apply across the whole national territory except protected areas.

Definición de pesca deportiva

La pesca se clasifica: (...) 2. Por su finalidad, en: (...) 2.3 Pesca deportiva: la que se realiza con fines de recreación o esparcimiento y sin fines comerciales, la Aunap definirá las especies, zonas, épocas, artes, volúmenes y métodos para el desarrollo sostenible de la actividad.
Arpón autorizado solo para especies exóticas o trasplantadas

Se autoriza el arpón como método de pesca dirigido a la captura de individuos de especies exóticas o trasplantadas, en aguas que no sean propias de su distribución natural (especies no nativas, procedente de otra región de origen).
Permiso obligatorio para la pesca deportiva (nacionales y extranjeros)

Para el ejercicio de la pesca deportiva en Colombia, es necesario contar con un permiso expedido por la Aunap; para persona natural, nacional o extranjera, representado en un carné de uso personal e intransferible; para las personas jurídicas, en una resolución de autorización para la realización de torneos o concursos, previo registro de la persona jurídica ante la Aunap.
Retención solo para autoconsumo y con tallas mínimas (Capture y Libere)

Aun cuando se orienta a la práctica del "Capture y Liberé" como premisa de la pesca deportiva, se autoriza que se conserven con fines de autoconsumo, individuos que cuenten con las tallas mínimas de captura establecidas en la presente resolución.
Validez y carácter del permiso de pesca deportiva

El permiso se otorgará hasta por cinco (5) años mediante la expedición de un carné que identifique a su titular. Este carné tendrá el carácter de personal e intransferible y en él se fijará su vigencia.

La pesca con arpón únicamente podrá ser practicada mediante buceo libre en la modalidad de apnea y solo con un arpón de liga o resorte por persona. Se prohíbe la pesca con arpón en horarios nocturnos e igualmente el uso de ganchos y fisgas o tridentes, así como de dispositivos de atracción luminosa. Estos aplican en todo el territorio nacional, a excepción de las áreas protegidas, donde será la autoridad ambiental correspondiente, en el ejercicio de sus competencias y funciones, la que podrá aplicarlos, según el caso. La pesca deportiva solo podrá ser realizada sin ánimo de lucro, de modo que está prohibida la comercialización de los ejemplares capturados o porciones de ellos por parte de los pescadores deportivos.
