Recreational spearfishing (underwater hunting) is practised and not prohibited in the Faroe Islands, but it is governed by a permissive legal framework rather than a free-for-all. The Faroe Islands are a self-governing nation within the Danish Realm with their own fisheries jurisdiction (outside the EU). The governing statute is the Act on Marine Resources (Løgtingslóg nr. 152 frá 23. desember 2019 um sjófeingi — 'Sjófeingislógin'; the earlier '161/2017' reference was the bill number — the enacted law is nr. 152/2019, last amended by løgtingslóg nr. 49 of 29 May 2026). All living marine resources in Faroese waters are the property of the Faroese people (§ 3). Recreational/household fishing ('veiða til húsbrúks') is addressed in § 35: it may NOT be conducted from a foreign-flagged vessel, and household catch may not be landed/sold; critically, § 35 stk. 2 empowers the Minister of Fisheries (Landsstýrismaðurin) to set detailed rules on gear (reiðskap), fishing methods (fiskileiðir), protected areas (friðað øki), catch quantity, species bans, and special permits — so spearfishing, while not separately banned, sits under this regulation-making power. Tourism-related fishing (how commercial operators such as Spearfishing.fo, Tórshavn run) requires a special permit from the Minister under § 35 stk. 3, with conditions on gear/methods/areas/quantities, and catch from such fishing may not be sold. No standalone spearfishing-specific Faroese kunngerð (executive order) on speargun/harpoon use was located. Coastal/shore sea fishing for personal use is generally permitted without a permit, but local exceptions apply. Two general recreational rules apply: fish under 30 cm may not be kept (catch-and-release), and any catch must be consumed within the Faroe Islands. Protected marine areas exist: three Ramsar seabird islands (Nólsoy, Mykines, Skúvoy) carry a navigation restriction (8-knot limit within 500 m of land, 15 Apr–31 Aug; jet-skis/noise banned) under Kunngerð nr. 144/2017, and the Nature Conservation Act (Løgtingslóg nr. 70/2023 um náttúruvernd) § 24 allows designation of marine protected areas ('sjóverndarøkir') in which nothing reducing the protection values is permitted. Status is 'restricted' because the activity is legal but hedged by ministerial gear/area rules, the tourism-permit requirement, the 30 cm/consume-locally rules, and marine/Ramsar protected zones; divers should confirm local exceptions and protected-area boundaries before diving.

- No spearfishing-specific equipment kunngerð (e.g. speargun/harpoon type, scuba-while-spearfishing) was located in public Faroese sources. The Minister of Fisheries holds the statutory power to set gear ('reiðskap') and method ('fiskileiðir') rules for household and tourism fishing (Sjófeingislóg § 35 stk. 2 and stk. 3), but no executive order exercising that power over spearfishing was found.
Spearfishing with a speargun is practised by local and commercial operators (e.g. Spearfishing.fo, Tórshavn); no statutory prohibition on spearguns was found. The governing Act on Marine Resources (Sjófeingislóg nr. 152/2019) § 35 lets the Minister regulate gear and methods for recreational ('húsbrúks') and tourism fishing, so gear rules could be imposed by ministerial order, but none specific to spearfishing was located. Whether scuba-assisted spearfishing is permitted is unknown from available sources.

Inland/freshwater spearfishing: No source permits spearfishing in Faroese inland/freshwater bodies; all freshwater fishing guidance refers exclusively to rod-based angling (fly fishing, lure), and permits for named association-managed lakes (Leynavatn, Mjóuvøtn, Saksunarvatn) are issued only for angling — making spearfishing in freshwater effectively unpermitted, though no explicit statutory prohibition specific to freshwater spearfishing was located in publicly available sources.
