Bahamas

Americas · Caribbean

Spearfishing is legal in The Bahamas but tightly restricted. Spear guns are banned outright; only a Hawaiian sling (and, in practice, a pole spear) may be used, and a visitor must have the spear endorsed on a sport fishing permit. Any underwater breathing apparatus other than a snorkel (SCUBA, hookah, air compressors) is prohibited for spearfishing, so all spearfishing must be on breath-hold (free-diving). Spearfishing is banned within 1 mile of the coast of New Providence, within 1 mile of the southern coast of Freeport (Grand Bahama), and within 200 yards of the coast of every other (Family/Out) Island, and is entirely prohibited inside national parks and no-take marine reserves such as the Exuma Cays Land and Sea Park. Spearfishing tournaments/competitions in the exclusive fishery zone are prohibited. Catch and size limits, closed seasons and species protections apply.

Einschränkungen

  • Spear guns are prohibited (only a Hawaiian sling, or in practice a pole spear, is permitted; a Hawaiian sling is a device for discharging a missile underwater by the force of a rubber sling).
  • No underwater breathing apparatus other than a snorkel may be used or possessed with intent to use for fishing (SCUBA, hookah and air compressors are 'prohibited apparatus').
  • All spearfishing must be on breath-hold (free-diving) using a snorkel only.
  • Spear use must be specifically authorised and endorsed in writing on the sport fishing permit.
  • Firearms are prohibited for fishing (except a 'bang stick' for self-defence against sharks and scientific use with Ministerial permission).
  • Explosives and poisons are prohibited for fishing.
  • Air compressor exception applies only by permit to Bahamians, between 1 August and 31 March, at depths of 30 to 60 feet.

The 'prohibited apparatus' definition (no underwater breathing device other than a snorkel) makes SCUBA/hookah spearfishing illegal. Spear guns are banned because only an Hawaiian sling is an allowed device to discharge a missile underwater.

  • Observe all coastal exclusion zones, no-take parks, catch/size limits and closed seasons.

Sportsfishing is defined as foreign fishing within the exclusive fishery zone for sporting or non-commercial purposes. Permanent residents are treated as Bahamians for these rules.

  • Observe coastal exclusion zones, no-take parks, catch/size limits and closed seasons.

  • Air compressor permit (depth 30–60 ft, 1 Aug – 31 Mar) is available to Bahamians only (BSD 10 fee).
  • Permanent residents are treated the same as Bahamians for sportsfishing rules.

Anmerkungen des Rechercheurs

Verbatim legal provisions were taken directly from the official consolidated statute PDF on laws.bahamas.gov.bs (Fisheries Resources (Jurisdiction and Conservation) Regulations, Ch. 244, LRO 1/2017), extracted locally because WebFetch could not parse the binary PDF. Key takeaways for spearfishers: spear gun banned (only Hawaiian sling/pole spear); no SCUBA/hookah/compressor (free-diving only); coastal exclusion zones (1 mile off New Providence; 1 mile off south Freeport; 200 yards off all other Family Islands); national parks/no-take reserves (e.g. Exuma Cays Land and Sea Park) are fully off-limits; spearfishing tournaments banned; a sport fishing permit with a written spear endorsement is required. Coordinates for prohibited zones are approximate centroids/coast reference points of the named islands/parks (the legal boundary is the statutory distance from the low-water mark, not a single point) and should be treated as indicative. Confidence is high for the national law text (official primary source); medium for some operational details (e.g. exact current permit fees, which are periodically amended by statutory instrument).
