Spearfishing is legal in The Bahamas but tightly restricted. Spear guns are banned outright; only a Hawaiian sling (and, in practice, a pole spear) may be used, and a visitor must have the spear endorsed on a sport fishing permit. Any underwater breathing apparatus other than a snorkel (SCUBA, hookah, air compressors) is prohibited for spearfishing, so all spearfishing must be on breath-hold (free-diving). Spearfishing is banned within 1 mile of the coast of New Providence, within 1 mile of the southern coast of Freeport (Grand Bahama), and within 200 yards of the coast of every other (Family/Out) Island, and is entirely prohibited inside national parks and no-take marine reserves such as the Exuma Cays Land and Sea Park. Spearfishing tournaments/competitions in the exclusive fishery zone are prohibited. Catch and size limits, closed seasons and species protections apply.

(1) In sportsfishing the following rules apply — (a) a person shall fish by the traditional method of angling with a hook or lure attached to a line held in the hand or attached to a pole, rod or reel; (b) a person, unless otherwise authorised by the respective permit, shall not use a spear, a fish trap, or a net other than a landing net; (c) each vessel shall use not more than 6 rods or reels unless the operator is in possession of a permit authorising the use of more rods or reels; (d) any migratory fishery resource (such as Kingfish, Dolphin, Tuna or Wahoo) that is caught shall not in total exceed 18 fish aboard the vessel at any time; (e) any Billfish (such as Marlin, Sailfish or Swordfish) caught shall be returned to the sea unharmed except where landed under the terms of an approved sportsfishing event or tournament; and (f) no vessel shall have on board at any time — (i) turtle; (ii) conchs, exceeding 6; (iii) crawfish, exceeding 10; or (iv) other demersal fishery resources exceeding 60 pounds or 20 fish.

The 'prohibited apparatus' definition (no underwater breathing device other than a snorkel) makes SCUBA/hookah spearfishing illegal. Spear guns are banned because only an Hawaiian sling is an allowed device to discharge a missile underwater.

Crawfish minimum size is 3.25 inches carapace (base of horns to end of jacket) ~8.3 cm, or 5.5 inch (~14 cm) tail if severed. Grouper/rockfish minimum 3 pounds. Stone crab claw minimum 4 inches. Min_size_cm of 0 is used where the legal limit is by weight, not length.

Sportsfishing is defined as foreign fishing within the exclusive fishery zone for sporting or non-commercial purposes. Permanent residents are treated as Bahamians for these rules.

Residentes

Bahamian nationals fishing recreationally for food for themselves and family generally do not need a sportsfishing permit; commercial fishing requires the relevant commercial permits/licences.
