Recreational spearfishing in Japan is heavily restricted. Spearguns and underwater guns (水中銃) are prohibited for recreational fishers nationwide because they are not among the gear/methods permitted for recreational fishing (遊漁) under the prefectural Fishery Adjustment Regulations; their use is reserved for licensed commercial fishery. Using diving equipment (including simple/scuba apparatus) together with a spear or hand collection is also prohibited. What recreational fishers MAY use is a hand-held pole spear (やす/もり) where the tip is fixed to the shaft and there is no launching mechanism; a power rubber is only allowed if it is weak enough to keep the handle in the user's hand on release. Thus only basic free-dive pole-spearing (from shore or a boat, without scuba) is lawful, while powered spearguns and scuba-assisted spearing are illegal. Detailed gear, season, size and area rules are set by each prefecture, so local Fishery Adjustment Regulations must be checked. Foreigners may not engage in fishery that requires a fishing licence and may not harvest species subject to common fishing rights (e.g. shellfish, lobster, sea cucumber). Violations carry up to 3 years imprisonment or a fine up to 30 million yen.

Please note that collecting aquatic animals and plants using fishing gear and fishing methods other than those listed here is a violation of regulations [penalty: fine]. The definition of "pole spear" which is permitted for recreational use: It is a fishing gear used to catch fish by piercing it. The tip and handle are fixed together. You can also attach a rubber to the end of the handle. However, recreational fishermen are only permitted to use a rubber with restricted power to keep the handle in the user's hands when releasing it. Recreational fishermen are prohibited from using spear guns! (permitted only in commercial fishery). Furthermore, commercial fishing by foreigners is prohibited by the Act on the Regulation of Fishing Operations by Foreign Nationals.   • Areas under common fishing rights (gyogyo-ken) nationwidefishing-rights / cooperative-managed area

    Coastal areas managed by local Fishery Cooperative Associations hold common fishing rights over designated species (shellfish, lobster, sea cucumber, certain seaweeds, etc.). Non-members, including all foreigners, may not harvest these species; doing so can be prosecuted under Article 195 of the Fishery Act (fine up to 1 million yen in Okinawa). These rights cover most productive nearshore reef areas.

The detailed law_texts entries quoting per-species size/season limits, MPAs and penalties are taken from the official Okinawa Prefecture pamphlet (Article 37 for recreational gear, Article 34/33, and Fisheries Act Art. 132); equivalent figures in other prefectures are set by their own Fishery Adjustment Regulations and were not individually fetched.
