Duxbury Reef State Marine Conservation Area (California)

The Duxbury Reef shale platform off Bolinas, Marin County (0.69 sq mi), bounded by the mean high tide line and 1000 feet seaward of mean lower low water — the largest intertidal reef in California. 14 CCR §632(b)(50)(B) permits only "the recreational take of finfish from shore and abalone". Because 14 CCR §1.76 defines spearfishing as taking fish by a person who is IN THE WATER, the shore-only carve-out is not available to a diver, so spearfishing is prohibited throughout the SMCA. 14 CCR §28.90 permits spear gear only to “Persons who are floating or swimming in the water”, and 14 CCR §632(a)(1)(C) makes all take unlawful except as specified in §632(b) — where ten other subparagraphs name “spearfishing [Section 1.76]” expressly when they permit it. Duxbury Reef does not.
