Marmion Marine Park waters beyond 1800 m from the mainland (Western Australia)

The outer part of Marmion Marine Park, more than 1800 m seaward of the mainland high water mark, is one of the few places in the Perth metropolitan area where spearfishing is expressly permitted by name. Schedule 4 item 3 of the Prohibition on Recreational Fishing (Marmion Marine Park) Order 1999 exempts “fishing by means of a pointed instrument not less than 1800 metres from the high water mark on the mainland in the waters described in Schedule 1, provided that compressed air breathing apparatus is not used”. Three conditions therefore attach: the ground must be in a General Use Area (not one of the three sanctuary areas, and not the Waterman Recreation Area), it must be at least 1800 m off the mainland, and the diver must be on breath-hold — scuba or hookah spearfishing is not permitted. Sea urchin may not be taken by pointed instrument (Schedule 4 item 9). Ordinary statewide size, bag and protected-species rules still apply.
