Recreational spearfishing is illegal throughout the Turks and Caicos Islands. Under the Fisheries Protection Regulations (Cap. 104), it is an offence to be in possession of a spear gun anywhere within the fishery limits (or within fifty feet of any tidal water, on any beach or foreshore, while swimming, or in any vessel). Hawaiian slings may only be used by holders of a commercial fishing licence, so no recreational spear of any kind is permitted. Taking marine products with scuba equipment is also prohibited except under a specially endorsed licence. The single exception is the invasive lionfish: lionfish are the only species that may be legally speared recreationally, the only marine product that may be taken with scuba gear, and the only product that may be taken inside national parks and nature reserves — and only under a lionfish licence issued by the Department of Environment and Coastal Resources / Department of Fisheries and Marine Resources Management. Penalties for breach are up to a $50,000 fine and/or twelve months' imprisonment.

Talablar

  • Non-Belongers may not take marine products for recreation without a licence (the Belonger recreational exemption in Reg. 4(2)(a) does not extend to non-Belongers).
  • Visitors who wish to do legal (line/rod) recreational fishing need a Sports Fishing Licence; charters often arrange this.
  • A lionfish licence (the only route to any spearing) can in practice only be bought in person at the Department of Fisheries and is reported to be difficult to obtain for short-term visitors.

Cheklovlar

  • Recreational spearfishing is prohibited for everyone, residents and foreigners alike — spear-gun possession is an offence within the fishery limits.
  • Non-Belonger commercial licence holders may only take marine products while using a trap or diving boat owned by a Belonger (Reg. 7(3)(d)).

There is no licence category that permits a foreign visitor to spearfish for general species. Foreigners are limited to line/rod sports fishing under a Sports Fishing Licence, or (in theory) lionfish removal under a lionfish licence.

Rezidentlar

Belonger recreational exemption (Reg. 4(2)(a)); Commercial Fisherman's Licence for residents engaged in commercial fishing

Talablar

  • Belongers may take reasonable quantities of marine products for pleasure, recreation or home consumption without a licence, except during a close season or by a prohibited apparatus/method.
  • Commercial Fishing Vessel Licences may only be issued to Belongers (Reg. 6(1)(i)).

Imtiyozlar

  • Licence-free recreational take of legal-size, in-season species for Belongers.
  • Holders of a commercial fishing licence are the only persons permitted to use a Hawaiian sling, and the only persons permitted to possess or purchase marine products taken by spear gun or Hawaiian sling.

Even Belongers and commercial licence holders may not use a prohibited apparatus or method; the recreational exemption never authorises spear-gun use, and spear-gun possession remains an offence for everyone.

Tadqiqotchi izohlari

Spearfishing is comprehensively banned in the Turks and Caicos Islands for recreational fishers: mere possession of a spear gun within the fishery limits is an offence (Reg. 11(2)), and 'spear fishing' is defined broadly to include any spear of any description, including Hawaiian slings. Hawaiian slings are restricted to commercial fishing licence holders. The only lawful spearing is of the invasive lionfish under a dedicated lionfish licence issued in person by the Department of Fisheries; lionfish is also the sole exception to the scuba-take ban and the only marine product takeable inside national parks/nature reserves. Verbatim legal text was extracted directly from the official Laws of Turks & Caicos Islands Fisheries Protection Regulations (Cap. 104) PDF hosted on FAOLEX (faolex.fao.org/docs/pdf/tci14804.pdf), giving high confidence in the prohibition, licensing, close-season and size-limit provisions. Size limits in law are in inches/ounces; cm equivalents in catch_limits are conversions and the canonical figures are the inch values in Regulation 14. License fee figures ($10/$30/$60) are from secondary tourism/government summaries and should be confirmed against the current DECR fee schedule. Coordinates for national parks are approximate centroids for mapping. The Fisheries Protection Regulations carry a base revision date of 15 May 1998; the parent Ordinance is Cap. 104 (consolidated 2003, revised 2009).
