Recreational spearfishing (pesca marítima de recreo submarina) is legal in Spain but tightly regulated. At national level it is governed by Real Decreto 347/2011 (for exterior waters), which restricts it to breath-hold (free) diving only: any underwater breathing apparatus (scuba) is prohibited, as are mechanical propulsion devices, night fishing, loaded spearguns out of the water, and explosive/electric points. A spearfishing activity licence issued by the competent coastal Autonomous Community is mandatory; in practice the Autonomous Communities also issue licences for exterior waters by delegation and set additional rules (minimum age, medical certificate of fitness for free diving, signalling buoy, distance from beaches/swimmers, catch caps). Only fish and cephalopods listed in Annex I may be taken, respecting the minimum sizes of Real Decreto 560/1995. Spearfishing is banned inside marine reserves of fishing interest (reservas marinas de interés pesquero) and other MPAs. A federation licence and personal accident insurance are commonly required to use a mechanically-powered speargun.

- Only a hand-thrown or mechanically-powered harpoon/speargun (arpón manual o impulsado por medios mecánicos), with one or more points, is permitted (Art. 14.1 RD 347/2011).
- Underwater breathing apparatus (scuba/escafandra autónoma) is prohibited - spearfishing must be done on breath-hold only (Art. 3.c, Art. 14.2 RD 347/2011).
- Mechanical propulsion devices and water scooters/hydrosliders (artefactos hidrodeslizadores) are prohibited (Art. 16.c RD 347/2011).
- The speargun may not be loaded out of the water (Art. 16.a RD 347/2011).
- Explosive, electric or electronic points and light beams are prohibited; only hand torches are allowed (Art. 16.b RD 347/2011).
- A clearly visible signalling buoy is mandatory and the diver must stay within 25 m of it (Art. 15 RD 347/2011).
- Several Autonomous Communities additionally require a federation licence and personal accident insurance to use a mechanically-powered speargun.
Spearfishing is legally restricted to free (breath-hold) diving. Possession of both spearfishing gear and breathing equipment together on a vessel is itself an offence (Art. 14.2).

National recreational maritime fishing cap is set per management zone by ministerial order; for submarine fishing a maximum of 5 kg per licence holder and day is widely applied (one larger single specimen may be excluded from the weight count). Some Autonomous Communities set their own caps (e.g. Cataluña 10 kg/person/day). Verify the cap in force for the specific region.

State marine reserve of fishing interest on the southwestern coast of La Palma (Canary Islands), mostly in the municipality of Fuencaliente. It extends between Caleta de los Pájaros and Punta Gruesa out to the 1,000 m isobath (3,455 ha). Recreational maritime fishing — including spearfishing — is not permitted within the reserve (only authorised autonomous diving and limited shore fishing outside the integral zone). Note: per MAPA the governing order is Orden APA/1936/2002 (the researcher's cited ARM/2094/2010 could not be confirmed).

Small state marine reserve (457 ha) on the Mediterranean coast off El Vendrell / Coma-ruga (Tarragona), established by Orden of 21 December 1999. Recreational spearfishing is not a permitted use; an integral reserve circle (0.2 NM radius) is centred at 41°10'27"N, 1°30'40.2"E with a 0.6 NM concentric buffer where only authorised professional fishing/diving is allowed.
- Parque Nacional Marítimo-Terrestre del Archipiélago de Cabreranational park marine zone
Maritime-terrestrial national park established by Ley 14/1991 covering the Cabrera archipelago and its surrounding sea south of Mallorca (boundaries later expanded in 2019). Sport fishing in all its forms and underwater fishing (pesca submarina) are prohibited within the park; only traditional professional artisanal fishing is exempted (per the Management and Use Plan). Diving/submarinismo is prohibited except with express authorization for research, conservation or public-use purposes (Article 3). Representative point south of Mallorca near the Cabrera archipelago.

Regional marine reserve along Menorca's northern Tramuntana coast. Spearfishing (pesca submarina) is prohibited throughout the reserve; vessels navigating reserve waters may not carry spearguns (fusiles de pesca submarina). The reserve is zoned: an integral-protection Zone A where all spearfishing and extraction of marine flora/fauna is banned, a Zone B where spearfishing is prohibited except where the Direcció General de Pesca authorizes it, and a Zone C where diving and recreational fishing are allowed with authorization. Representative point on Menorca's north coast.
- Reserva Marina dels Freus d'Eivissa i Formenteramarine reserve
Regional marine reserve (13,617 ha) occupying the channel and waters between southern Ibiza (Punta des Jondal / Punta de sa Mata) and northern Formentera (Punta de sa Gavina / Punta Prima), established by Decreto 63/1999 of 28 May. Underwater fishing (pesca submarina) is prohibited throughout the entire reserve. The integral/special-protection zone east and northeast of the s'Espardell islet has the strictest protection where all resource extraction is banned except for scientific purposes. Representative point in the channel between Ibiza and Formentera.

Regional marine reserve (3,756 ha) along the northeast coast of Ibiza and the islet of Tagomago, established by Decreto 45/2018 (modified by Decreto 45/2024). Spearfishing (pesca submarina) and all non-specifically-authorized extraction of marine flora/fauna are prohibited. The reserve is bounded by coordinates including A: 38°59'34.80"N/1°33'39.60"E (Santa Eulària coastline) and D: 39°01'49.80"N/1°39'04.80"E (Tagomago vertex).
Regional marine reserve in southwest Mallorca off Calvià, established in its current form by Decreto 26/2025 of 4 July (replacing the earlier el Toro/les Malgrats reserve). All maritime fishing and extraction of marine flora and fauna is restricted; high-protection zones around El Toro, Les Malgrats and El Sec apply the strictest limits. The reserve boundary runs from Cabo des Falcó (A: 39°29.184'N/2°32.116'E) to Morro d'en Grosser (G: 39°30.589'N/2°27.558'E), enclosing the El Toro, Les Malgrats and El Sec islets.
- Reserva Marina de la Illa de l'Airemarine reserve
Regional marine reserve around the Illa de l'Aire islet off the southeast tip of Menorca, established by Decreto 26/2019 of 12 April. Spearfishing (pesca submarina) is prohibited; the reserve includes a special integral-protection zone where extraction of any flora or fauna is banned. The islet lies off the southeast corner of Menorca, with the reserve extending along the adjacent coast. Representative point at the Illa de l'Aire.

Regional marine reserve (1,059 ha) protecting the sea around the La Mola promontory at the eastern end of Formentera, established by Decreto 38/2018 of 16 November. Spearfishing (pesca submarina) and all non-authorized fishing are prohibited; the reserve protects extensive Posidonia oceanica meadows. The reserve lies in the interior waters of La Mola, between Punta de la Fernanda and Punta des Far. Representative point off La Mola headland, eastern Formentera.

Spain has a two-tier system: national Real Decreto 347/2011 governs exterior waters and sets the core submarine-fishing rules (breath-hold only, no scuba, harpoon/speargun only, mandatory buoy, night ban, authorized species), while the 17 coastal Autonomous Communities regulate interior waters and issue the licences (and also issue exterior-waters licences by delegation), each adding their own age, medical-certificate, fee, validity, distance-from-shore and catch-cap rules. Therefore exact figures (licence cost, validity, daily catch cap, distance to swimmers/beaches) MUST be checked against the specific Autonomous Community where diving takes place. The 5 kg/day cap and the medical-certificate/age-16 requirements are widely applied but their precise legal basis is regional; they are reported here from official regional sources and reputable secondary sources. Per-species minimum sizes (RD 560/1995 and regional updates) were not transcribed individually. Verbatim national articles (Art. 3.c, 4, 12, 13, 14, 15, 16) and the Columbretes reserve prohibition were taken directly from BOE official consolidated texts. Inland/freshwater spearfishing: Spearfishing (pesca subacuática) in inland and freshwater bodies is effectively prohibited across Spain: inland fishing competencies belong to the Autonomous Communities, and every regional law examined expressly bans it — including Galicia (Ley 2/2021, Art. 35.1.k) and Catalonia (Ley 22/2009, Art. 34.f); continental fishing orders permit only rod-and-line, leaving no lawful pathway for spearfishing in rivers, lakes, or reservoirs.
