Faroe Islands

Europe · Northern Europe

Recreational spearfishing (underwater hunting) is practised and not prohibited in the Faroe Islands, but it is governed by a permissive legal framework rather than a free-for-all. The Faroe Islands are a self-governing nation within the Danish Realm with their own fisheries jurisdiction (outside the EU). The governing statute is the Act on Marine Resources (Løgtingslóg nr. 152 frá 23. desember 2019 um sjófeingi — 'Sjófeingislógin'; the earlier '161/2017' reference was the bill number — the enacted law is nr. 152/2019, last amended by løgtingslóg nr. 49 of 29 May 2026). All living marine resources in Faroese waters are the property of the Faroese people (§ 3). Recreational/household fishing ('veiða til húsbrúks') is addressed in § 35: it may NOT be conducted from a foreign-flagged vessel, and household catch may not be landed/sold; critically, § 35 stk. 2 empowers the Minister of Fisheries (Landsstýrismaðurin) to set detailed rules on gear (reiðskap), fishing methods (fiskileiðir), protected areas (friðað øki), catch quantity, species bans, and special permits — so spearfishing, while not separately banned, sits under this regulation-making power. Tourism-related fishing (how commercial operators such as Spearfishing.fo, Tórshavn run) requires a special permit from the Minister under § 35 stk. 3, with conditions on gear/methods/areas/quantities, and catch from such fishing may not be sold. No standalone spearfishing-specific Faroese kunngerð (executive order) on speargun/harpoon use was located. Coastal/shore sea fishing for personal use is generally permitted without a permit, but local exceptions apply. Two general recreational rules apply: fish under 30 cm may not be kept (catch-and-release), and any catch must be consumed within the Faroe Islands. Protected marine areas exist: three Ramsar seabird islands (Nólsoy, Mykines, Skúvoy) carry a navigation restriction (8-knot limit within 500 m of land, 15 Apr–31 Aug; jet-skis/noise banned) under Kunngerð nr. 144/2017, and the Nature Conservation Act (Løgtingslóg nr. 70/2023 um náttúruvernd) § 24 allows designation of marine protected areas ('sjóverndarøkir') in which nothing reducing the protection values is permitted. Status is 'restricted' because the activity is legal but hedged by ministerial gear/area rules, the tourism-permit requirement, the 30 cm/consume-locally rules, and marine/Ramsar protected zones; divers should confirm local exceptions and protected-area boundaries before diving.

如何办理
For coastal sea fishing for personal use no permit is needed (Sjófeingislóg § 35 reserves household fishing rule-making to the Minister but no general licence regime was located for shore/coastal personal-use fishing). Tourism/commercial fishing in Faroese waters requires a special permit from the Minister of Fisheries (Sjófeingislóg § 35 stk. 3). For specific freshwater lakes leased by the Faroese Fishing Association (Leynavatn, Mjóuvøtn, Saksunarvatn) a fishing licence must be purchased locally; some lakes/rivers are privately owned and require the owner's permission.

限制

  • All fishing/diving equipment (rods, reels, rubber waders, lures, and by extension wetsuits/gear) must be cleaned and disinfected before arrival in the Faroe Islands to prevent the spread of fish diseases; no veterinary certificate is required.
  • No spearfishing-specific equipment kunngerð (e.g. speargun/harpoon type, scuba-while-spearfishing) was located in public Faroese sources. The Minister of Fisheries holds the statutory power to set gear ('reiðskap') and method ('fiskileiðir') rules for household and tourism fishing (Sjófeingislóg § 35 stk. 2 and stk. 3), but no executive order exercising that power over spearfishing was found.

Spearfishing with a speargun is practised by local and commercial operators (e.g. Spearfishing.fo, Tórshavn); no statutory prohibition on spearguns was found. The governing Act on Marine Resources (Sjófeingislóg nr. 152/2019) § 35 lets the Minister regulate gear and methods for recreational ('húsbrúks') and tourism fishing, so gear rules could be imposed by ministerial order, but none specific to spearfishing was located. Whether scuba-assisted spearfishing is permitted is unknown from available sources.

要求

  • Disinfect all fishing/diving equipment before arrival.
  • Consume any catch within the Faroe Islands; catch may not be taken/exported out of the country.
  • Obtain a local permit for freshwater angling where required.
  • Household/recreational fishing ('veiða til húsbrúks') may NOT be conducted from a foreign-flagged vessel (Sjófeingislóg § 35); guided/tourism fishing in Faroese waters requires a special ministerial permit (§ 35 stk. 3) and catch from it may not be sold.

限制

  • Fish under 30 cm must be released.
  • No household-fishing catch may be landed or sold (Sjófeingislóg § 35).

Tourists may take part in recreational sea fishing and spearfishing; the national tourism board markets diving and spearfishing experiences to visitors. A guided/commercial spearfishing operation in Faroese waters falls under the tourism-fishing special-permit regime of Sjófeingislóg § 35 stk. 3. No foreigner-specific personal-use spearfishing licence was identified, but recreational fishing from a foreign-flagged boat is barred.

研究员备注

The Faroe Islands is a self-governing nation within the Kingdom of Denmark with its own fisheries legislation, distinct from Denmark and the EU (it is outside the EU). 2026-06-22 deepening: the governing statute was confirmed and read in verbatim Faroese from the official law portal (logir.fo). The current Act on Marine Resources is Løgtingslóg nr. 152 frá 23. desember 2019 um sjófeingi ('Sjófeingislógin'), last amended by løgtingslóg nr. 49 frá 29. mai 2026 — the previously cited '161/2017' was the bill (løgtingsmál) number, so the legal_status now references the enacted nr. 152/2019. Key verbatim provisions captured: § 3 (resources are the property of the Faroese people); § 35 (household/recreational fishing 'veiða til húsbrúks' — barred from foreign-flagged vessels, no sale of household catch; § 35 stk. 2 reserves to the Minister of Fisheries the power to set rules on gear, methods, protected areas, catch quantity, species bans and special permits; § 35 stk. 3 requires a special ministerial permit for tourism-related fishing and bars sale of its catch). Because spearfishing is legal but conditioned by these ministerial gear/area powers, the 30 cm / consume-locally rules, the tourism-permit requirement for guided trips, and marine/Ramsar protected zones, spearfishing_allowed was raised from a flat 'yes' to 'restricted', and data_confidence from 'low' to 'medium'. Protected-area framework confirmed: the Nature Conservation Act (Løgtingslóg nr. 70 frá 22. mai 2023 um náttúruvernd) § 24 allows designation of marine protected areas ('sjóverndarøkir') in which (stk. 5) nothing reducing the protection values is permitted — verbatim Faroese captured. Umhvørvisstovan (Faroese Environment Agency, us.fo) administers nature conservation and the navigation restriction around the three Ramsar seabird islands (Kunngerð nr. 144 frá 7. november 2017 um sigling kring Ramsar-oyggjarnar Nólsoy, Skúvoy og Mykines): from 15 April to 31 August, boats may not exceed 8 knots within 500 m of land and jet-skis/unnecessary noise are banned. The three Ramsar zones already in this record (Nólsoy, Mykines, Skúvoy) carry WDPA polygons and coordinates. Firmly established from official/secondary sources: (1) recreational coastal sea fishing for personal use is generally allowed without a permit; (2) spearfishing is practised and not prohibited (active commercial operator + tourism-board promotion), but guided/commercial spearfishing needs a § 35 stk. 3 tourism permit; (3) no fish under 30 cm may be kept (catch-and-release); (4) any catch must be consumed within the Faroe Islands and may not be exported; (5) all equipment must be disinfected before arrival; (6) freshwater angling requires a local permit (named association lakes: Leynavatn, Mjóuvøtn, Saksunarvatn). Could NOT verify (omitted, not guessed): any standalone spearfishing/speargun-specific kunngerð (executive order) under § 35; spearfishing seasons; per-species catch/bag limits for underwater hunting; whether scuba-assisted spearfishing is permitted; cost/validity of any tourism permit; coordinates for any spearfishing-specific protected zone beyond the three already-mapped Ramsar islands. The Ramsar navigation-rule news page on us.fo and the Mykines Ramsar information sheet (rsis.ramsar.org/ris/2051) were intermittently unreachable (404/502/403) on 2026-06-22, so their figures rest on the existing cited Ramsar/Visit-Sandoy entries and the us.fo legislation index rather than a fresh fetch. Inland/freshwater spearfishing: No source permits spearfishing in Faroese inland/freshwater bodies; all freshwater fishing guidance refers exclusively to rod-based angling (fly fishing, lure), and permits for named association-managed lakes (Leynavatn, Mjóuvøtn, Saksunarvatn) are issued only for angling — making spearfishing in freshwater effectively unpermitted, though no explicit statutory prohibition specific to freshwater spearfishing was located in publicly available sources.
