Recreational and subsistence spearfishing is generally permitted in Kiribati coastal waters, but is materially restricted by the Fisheries (Conservation and Management of Coastal Marine Resources) Regulations 2019. Spearfishing while using SCUBA or hookah (underwater breathing) gear is prohibited (the gear ban allows it only for licensed aquarium-fish harvest and research). Spearfishing at night using any torch, spotlight or light is prohibited except for subsistence purposes. The Fisheries Act 2010 bans explosives, poisons and other destructive methods nationwide. Minimum size limits and lunar/seasonal closures apply to many target reef species (e.g. bonefish, Napoleon wrasse, emperors, snappers, mullet); giant clam is totally protected. The entire Kiribati EEZ is a Shark Sanctuary where taking sharks is prohibited (limited cultural-permit and inadvertent-catch defences only). On Kiritimati (Christmas Island), the main sport-fishing destination, a pleasure/sport-fishing permit is required, bonefish are catch-and-release only, and a daily limit of 5 fish per species applies; lodges promote fly/spin fishing and spearfishing is not part of the regulated sport offering. Commercial coastal fishing is reserved for local fishing vessels and requires a licence.

限制

  • Use of SCUBA and hookah (underwater breathing) gear for fishing is prohibited, except when used to harvest aquarium fish for export and research purposes (Regulation 7(1)(i), 2019). This effectively bans SCUBA/hookah-assisted spearfishing.
  • Spearfishing at night using any torch, spotlight or light is prohibited, except for subsistence fishing purposes (Regulation 7(1)(l), 2019).
  • Explosives, poisons and other noxious substances are prohibited nationwide (Fisheries Act 2010, s.21).
  • Use of crowbar or other objects to destroy/remove corals ('te rai atibu') is prohibited (Regulation 7(1)(h), 2019).

Breath-hold (free-dive) spearfishing is not itself banned. The key spearfishing-specific restrictions are the SCUBA/hookah prohibition and the night-with-light restriction (subsistence excepted). Penalty for prohibited methods/gears: fine up to AUD 10,000 and/or imprisonment.

要求

  • Visiting anglers require a pleasure/sport-fishing permit (on Kiritimati obtained at Cassidy International Airport on arrival, usually via the lodge).
  • Must comply with national rules: no SCUBA/hookah spearfishing, no night spearfishing with light, size limits, and the shark sanctuary prohibition.

限制

  • Bonefish catch-and-release only on Kiritimati; daily limit 5 fish per species.
  • Foreigners may not take sharks (shark sanctuary); the limited subsistence/cultural exception is for I-Kiribati, not visitors.
  • Commercial coastal fishing is reserved for local fishing vessels (Regulation 14(1)).

Spearfishing tourism is minimal; Kiribati's visitor fishing scene (Kiritimati) is dominated by fly and spin fishing for bonefish, GT and triggerfish. No verbatim provision specifically bans recreational breath-hold spearfishing by foreigners, but it is governed by the same coastal regulations.

居民

Subsistence and recreational fishing by I-Kiribati in coastal waters is broadly permitted subject to the 2019 Regulations; commercial coastal fishing requires a licence reserved for local fishing vessels.

要求

  • Comply with prohibited-methods rules (no SCUBA/hookah, no explosives/poisons).
  • Subsistence fishers are exempt from the night-spearfishing-with-light prohibition (Regulation 7(1)(l)).

优待

  • Subsistence exemption for night spearfishing with a light.
  • I-Kiribati may harvest sharks for traditional/subsistence food purposes (not commercially) under the shark sanctuary framework.
  • Commercial coastal fishery licences reserved for local fishing vessels.

Community-Based Fisheries Management (CBFM) plans and island by-laws may impose additional local closures and rules under the 2019 Regulations.

  • Main recreational/sport fishing destination in Kiribati. Pleasure/sport-fishing permit required (obtained on arrival at Cassidy International Airport). Bonefish are catch-and-release only; daily limit of 5 fish per species. Lodges focus on fly and spinning; spearfishing is not part of the regulated sport-fishing offering. National rules (SCUBA ban, night-spearfishing torch restriction, size limits, shark sanctuary) apply.

Permit required; bonefish catch-and-release; 5 fish per species per day; national Coastal Marine Resources Regulations 2019 apply.

禁止区域

  • Kiribati Shark Sanctuaryshark sanctuary (covers entire EEZ / all Kiribati waters)

The Kiribati Shark Sanctuary comprises all Kiribati waters. Catching, capturing, killing, fishing for, or finning sharks is prohibited (inadvertent-catch-and-release defence and Ministerial cultural permits only). This applies to any spearfishing targeting sharks.

研究员备注

Spearfishing in Kiribati is legal in principle (breath-hold/free-dive) but materially restricted. The decisive instrument is the Fisheries (Conservation and Management of Coastal Marine Resources) Regulations 2019: Regulation 7(1)(i) prohibits SCUBA/hookah gear for fishing (effectively banning SCUBA-assisted spearfishing) and Regulation 7(1)(l) prohibits night spearfishing using any torch/spotlight/light except for subsistence. The Fisheries Act 2010 s.21 bans explosives/poisons nationwide. The Shark Sanctuary Regulations 2015 make all Kiribati waters a no-take shark sanctuary. Schedule 1 sets minimum sizes and lunar/seasonal closures for many reef species and a total ban on giant clam. Verbatim legal text was extracted directly from the actual regulation/act PDFs (text layer via pdftotext), so confidence in the law texts is high. Some practical details (Kiritimati permit fees, the 5-fish-per-species daily limit, bonefish catch-and-release) come from a secondary travel/fishing source and are marked accordingly; the Kiritimati coordinate is the island centroid (Cassidy/London area), not a legal boundary. Exact MM-DD season dates for lunar closures are deliberately expressed relative to moon phase because the Regulation defines them that way rather than by calendar date.
