South Sudan is a landlocked country, so there is no marine spearfishing; the only relevant context is freshwater fishing in the White Nile, the Sudd wetland, and associated rivers and lakes. There is no spearfishing-specific legislation, but one concrete statutory restriction is directly on point: the Wild Life Conservation and National Parks Act 2003 limits all fishing inside any national park to 'hand held rod and lines' (Section 14(e)) and bars capturing any animal in a park (Section 13), so spearfishing/underwater hunting is not a permitted method within national parks (e.g. Nimule, Shambe, Boma, Badingilo). That Act has now been repealed and replaced by the Wildlife Conservation and Protected Areas Act, 2026 (signed by the President on 18 February 2026); the 2026 Act's full text and any fishing provisions were not retrievable, so the protected-area regime is described from the still-recently-in-force 2003 Act. Outside protected areas the general fishery is overwhelmingly artisanal and subsistence-based, and traditional gear such as spears, bows and arrows, traps and baskets has long been used. The governing general fisheries statute is the colonial-era Freshwater Fisheries Act 1954 (inherited from Sudan), whose legitimacy is itself described as doubtful in the country's own official policy document; controls under it cover mesh sizes, twine sizes and the forbidding of explosives and poisons, with a licensing system but otherwise effectively open access. A modern Fisheries Bill (drafted 2006, re-edited as the draft Fisheries Bill 2012) has NOT been enacted - a state Ministry official confirmed in 2024 that 'we are supposed to have a fisheries bill; it's not yet passed' and that the ministry is 'partly working with the 1954 Sudan Fisheries Law'. No provision specifically addresses recreational underwater (spear) fishing, and there is no defined recreational-spearfishing regime, so legality is best characterised as restricted: traditional spear-fishing is customary in general waters but prohibited inside national parks, and the overall framework is unsettled.

Current Legislation - status of fisheries law in South Sudan
Fisheries Policy for South Sudan 2012-2016 (citing the Freshwater Fisheries Act 1954)
The current legislation dates from the 1950s before the creation of the Republic of South Sudan and there is some doubt as to its legitimacy. It is contained in the Freshwater Fisheries Act 1954 which applies to all freshwater rivers and lakes in such parts of Sudan as the Minister of Animal Resources may, from time to time, notify in the Official Gazette (sect. 2). It includes various clauses including that no person shall introduce non-indigenous species without a permit (sect. 4). Other provisions relate to use of gear (sects. 5-7), licences for boats (sect. 8) fishing licences (sect. 9), regulation making powers of the Minister (sect. 10) and offences (sect. 11).

Licence types under the existing legislation
Fisheries Policy for South Sudan 2012-2016 (describing licences under the Freshwater Fisheries Act 1954 / draft Bill)
Licenses are issued for fishing, aquarium fish catching, sports fishing, fish processing (but no QC mentioned), fish trading, fish movement, culturing aquarium fish, export of aquarium fish, disposal of aquarium fish, import and export and sport fishing clubs.

A draft Fisheries Bill was prepared in 2006 and has now been re-edited as the draft Fisheries Bill 2012. The bill is based on a template from elsewhere, and has been adapted to the South Sudan, including some references to marine organisms of which there are none in South Sudan.
Controls on fishing effort under the existing legislation

Management of the fishery in the States is delegated to the States whose capacity is low. Controls on fishing effort cover mesh sizes, sizes of twines, the forbidding of explosives and poisons and there is a licensing system. Enforcement is very patchy. For all intents and purposes the fishery in South Sudan is an open access one, with no controls on numbers of fishers or entry.
Fishing in national parks restricted to hand-held rod and line (spearfishing effectively prohibited)
Wild Life Conservation and National Parks Act, 2003
Except with the written authorization of the Director General, which authorization shall be given only in the interest of the proper management and development of the national park, no person shall within any national park:- [...] e) Fish, otherwise than with hand held rod and lines; f) Obstruct, divert or pollute any river, pool, lake, or other points of water; g) Perform any act or engage in any other activity likely to destroy, endanger or disturb wildlife in the national park or to destroy or shelter or alter its natural habitat and environment. [The Act limits any fishing inside a national park to hand-held rod and line; spearfishing/underwater hunting is therefore not a permitted method within national parks. Section 15(a) further bars bringing in any weapon, trap or snare without written authorization.]
General prohibition on capturing animals within a national park

No person shall hunt, cut a plant or capture any animal within a national park. ['Animal' is defined in Section 4 as 'any vertebrate animal, bird, reptile, including wild fish eggs and young thereof, but does not include domestic animals.']

The Sudd is one of the world's largest tropical freshwater wetlands, formed by the White Nile between Malakal and Bor. The official policy document places it between 6 and 9 degrees 30 minutes N and 30 to 32 degrees E. It was designated a Wetland of International Importance under the Ramsar Convention on 5 June 2006. It is a critical fish breeding and biodiversity area; while artisanal/subsistence fishing by local communities continues, the area is a protected wetland of international importance and spearfishing is not a sanctioned recreational activity here.

Riverine/freshwater habitat; under the Wild Life Conservation and National Parks Act 2003 (Section 14(e)) fishing in a national park is limited to hand-held rod and line, so spearfishing is not a permitted method here.
- Shambe National Parknational park (White Nile / Sudd floodplain)
National park established 1985 on the west bank of the White Nile within the Sudd wetland system, protecting floodplain grasslands, oxbow lakes, riverine forest and seasonal wetlands. Freshwater/aquatic protected area; under the Wild Life Conservation and National Parks Act 2003 (Section 14(e)) fishing inside a national park is limited to hand-held rod and line, so spearfishing is not a permitted method here.
- Boma National Parknational park (grasslands / floodplains)
National park established 1977 in eastern South Sudan near the Ethiopian border, covering ~22,800 sq km of grasslands and floodplains, part of the Boma-Badingilo migratory landscape. Under the Wild Life Conservation and National Parks Act 2003 (Section 14(e)) fishing inside a national park is limited to hand-held rod and line, so spearfishing is not a permitted method here.
