Recreational marine spearfishing (pesca/caza submarina) is practiced legally along Argentina's Atlantic coast and is a recognised competitive sport governed by the Federacion Argentina de Actividades Subacuaticas (FAAS, CMAS member). Coastal hotspots include Las Grutas, San Antonio Oeste and Playas Doradas (Rio Negro) and Puerto Madryn and Comodoro Rivadavia (Chubut), which have hosted national and Pan-American championships. However, the activity is regulated at the provincial level (the national fisheries law focuses on commercial sea fishing), and it is explicitly PROHIBITED in continental/freshwater Patagonian waters under the Reglamento de Pesca Deportiva Continental Patagonico (Art. 22, which bans 'la caza subacuatica' and the use of 'arpones'), and harpoons are prohibited for sport fishing in National Parks. There is no single nationwide statute that affirmatively authorises marine spearfishing; legality therefore depends on the province and whether the water is marine or continental, hence the 'restricted' classification.

限制

  • Marine coastal practice typically uses band-powered or pneumatic spearguns/harpoons, 7mm wetsuit, mask/snorkel, fins, weight belt and a surface marker buoy (per reported sport practice in Rio Negro/Chubut).
  • Harpoons/spearguns are PROHIBITED in continental Patagonian sport-fishing waters (Reglamento de Pesca Deportiva Continental Patagonico, Art. 22) and for sport fishing in National Parks.
  • Whether SCUBA-assisted spearfishing is permitted (vs free-diving/apnea only) was not confirmed from a verbatim source; competitive spearfishing in Argentina is apnea-based.

Equipment legality is marine-vs-continental dependent. In marine coastal provinces spearguns are used lawfully for sport; in continental/freshwater Patagonia and National Parks they are banned.

允许区域

  • Coastal town in Rio Negro province; recognised marine spearfishing (caza submarina) area with rocky restingas (reefs, caves and crevices) holding species such as salmon (de mar), mero (grouper) and besugo (sea bream). Reported max diving depth ~15 m.

Spearfishers avoid the Parque Submarino (sunken-ship artificial reef) area; selective adult-only catch is the local norm.

  • Beach resort in Rio Negro that has hosted the Argentine Championship of Underwater Hunting (Campeonato Argentino de Caza Submarina).

    unknown

  • Coastal city in Chubut considered a 'mecca' of competitive underwater hunting; hosted the VII Pan-American Spearfishing Championship organised by FAAS.

    unknown

  • Coastal city in Chubut on Golfo Nuevo, with natural reefs; a well-known centre for diving and underwater hunting at sport level.

    unknown

禁止区域

  • Parque Submarino de Las Grutasartificial reef / underwater park (no-take by local convention; no verbatim statutory ban retrieved)

Underwater park ~5 km south of Las Grutas and ~7.5 km offshore, Rio Negro; four sunken fishing vessels (Don Felix, Chiarpesca, Mariana Rojamar, Polarborg) act as artificial reefs hosting dense marine life. Local spearfishers deliberately avoid hunting at these structures, treating them as protected artificial reefs.

  • Underwater hunting (caza subacuatica) and the use of harpoons are explicitly prohibited in continental sport-fishing waters under the Reglamento de Pesca Deportiva Continental Patagonico, Art. 22.

  • Harpoons (arpones) are listed among prohibited capture gear for sport fishing within Argentina's National Parks system.

  • Provincial protected area on the Atlantic coast of Río Negro, ~45 km from Viedma, ~1,900 ha (~600 ha terrestrial). Protects a major single-haired sea lion (Otaria flavescens) colony. IUCN Category VI; established 1971 (provincial law 898, boundaries set by Decree 1862/2005). Includes a 'zona intangible' (scientific-use untouchable zone), a restricted-use zone and a multiple-use zone. Spearfishing/extraction is incompatible with the reserve's protection regime. NOTE: the cited source does NOT mention Resolution 999/2015's shark/ray/chimaera fishing ban — that claim is unverified against this source.

  • Reserva Natural Turística Punta Lomamarine/coastal nature reserve

Provincial fauna reserve in Chubut (Biedma dept), on Golfo Nuevo near Puerto Madryn. Created 1967 (Provincial Law 697/67) — one of the country's oldest/smallest fauna reserves. Protects a permanent single-haired sea lion (Otaria flavescens) haul-out and seabird nesting colonies. As a wildlife protected area focused on marine-mammal and seabird colonies, extractive activities such as spearfishing are not permitted.

  • Provincial marine park created 1974 (Provincial Law 1238/74) in Golfo San José, Chubut, within the Península Valdés UNESCO World Heritage area. Protects a southern right whale (Eubalaena australis) reproduction zone. Extractive spearfishing within this protected marine park is incompatible with its conservation regime. Coordinate is a representative center point within the gulf.

  • Provincial protected area established 1993 on Golfo San Matías, Río Negro (San Antonio dept), encompassing intertidal/marine sectors near San Antonio Oeste/Este and the Las Grutas area. WHSRN/Hemispheric Site of International Importance for migratory shorebirds. Use restrictions apply; intertidal/marine sectors are protected bird-feeding habitat, so extractive activity including spearfishing is restricted. Coordinate is a representative center point within the bay.

  • Strict-category national park (Ley Nacional 25.945/04) on the Atlantic coast of Santa Cruz: 55,620 ha under the 'Parque Nacional' category (covering the marine/coastal core with seabird colonies and marine-mammal haul-outs) plus a 6,549 ha 'Reserva Nacional' buffer. Under Ley 22.351 Art. 4, 'queda prohibida toda explotación económica con excepción de la vinculada al turismo, que se ejercerá con sujeción a las reglamentaciones que dicte la Autoridad de Aplicacion' — all economic exploitation is banned except tourism-linked activities APN itself authorizes. The park's own visitor regulation authorizes ONLY seasonal rod-and-line sport fishing (individual free permit, 1 Jan-30 Apr, largemouth bass/pejerrey/palometa >30cm); underwater hunting/spearfishing is not among the activities APN has authorized and therefore remains banned by the park's default extraction prohibition.

  • National park created 2022 (Ley Nacional 27.670), protecting a sea-lion haul-out and seabird island complex on the Río Negro Atlantic coast near Sierra Grande. Comprises 14,155 ha under the strict 'Parque Nacional' category (the Mar Argentino/marine ecoregion sector, where the spearfishing-relevant waters lie) plus a smaller 'Reserva Nacional' terrestrial-steppe buffer (3,486 ha). Under Ley 22.351 Art. 4 all economic exploitation, including extractive fishing/underwater hunting, is prohibited within the Parque Nacional (marine) sector except tourism-linked activities expressly authorized by APN; no fishing/spearfishing authorization has been published for this park.

  • Argentina's first open-ocean MPA on the Burdwood Bank/Banco Namuncurá submarine plateau in the South Atlantic (created by Ley 26.875, 2013; adapted to the national MPA system, Ley 27.037, via Decreto PEN 888/2019). The Federal Fisheries Council's Resolucion CFP N.18/2008 established a zone of total fishing prohibition on the bank, made permanent by Disposicion SSPyA N.250/2008 ('prohibido en forma total y permanente la actividad pesquera en dicha zona'). The 2022 official management plan confirms the eastern strict-protection sectors -Reserva Nacional Marina Estricta (RNME, east of meridian 60 45'W, south of the 200 m isobath to parallel 55 45'S / meridian 58 00'W) and Parque Nacional Marino (PNM, east of meridian 60 45'W and the 200 m isobath)- both list 'Pesca comercial: Prohibido' and 'Prospeccion, Exploracion y Actividades Extractivas: Prohibido' with no sport/recreational-fishing exception at all (only the smaller western Reserva Nacional Marina sector permits regulated fishing under a fisheries management plan). Coordinate is the centroid of the original core ('zona nucleo') box 54 15'-54 30'S x 59 30'-60 30'W, which sits within the present-day RNME/PNM total-prohibition sector.

研究员备注

Argentina is a federal state: the national Regimen Federal de Pesca (Ley 24.922) governs commercial/maritime fishing, while recreational and sport fishing - including spearfishing - is regulated by the provinces and by sector regulations. KEY DISTINCTION: marine coastal spearfishing is practiced legally and competitively (FAAS-organised national and Pan-American championships in Rio Negro and Chubut), whereas underwater hunting (caza subacuatica) and harpoons are explicitly PROHIBITED in continental/freshwater Patagonian sport-fishing waters (Reglamento de Pesca Deportiva Continental Patagonico, Art. 22) and harpoons are barred for sport fishing in National Parks. Verbatim provisions were captured for the Patagonian continental prohibition and season; precise per-province marine spearfishing rules, licenses, catch and size limits for the main coastal provinces (Buenos Aires Ley 11.477, Rio Negro, Chubut, Santa Cruz) were not retrieved verbatim (some provincial sources are scanned image PDFs) - hence data_confidence is 'medium'. Anyone intending to spearfish should confirm the specific provincial regulation and any local marine-protected-area (e.g. Parque Submarino de Las Grutas) restrictions before fishing. Coordinates for zones are approximate town/site locations.
